The PCN will be bound by the IVA like any other secured debt, and whilst it'll be bound by the IVA getting the CCJ removed will likely be a pain in the *ahem* despite the fact it's bound. The likely scenario is that the wheels were already in motion to apply the CCJ whilst your IVA was being propose...

I would be cautious, as many creditors will see it as recent use of credit and reject your IVA on that basis, despite the secured debt not actually being bound by the IVA.

How lovely of them. What they fail to mention, however, is that they can reduce either your monthly payments or the total amount owed by up to 15% without the need to call a variation meeting of creditors. They also probably conveniently forget to mention that they will charge a variation fee for ca...

It may be worth your while answering to see what they want. I believe the IVA trusts department of Debt Movement/Jarvis/Aperture (and more historically Debt Free Direct, Clear Debt etc) were trying to distribute funds to people in old cases that have been lying dormant. Might be something, might be ...

It's worth noting that Creditifx, Logan Whyte and Ebene Gate are all heads of the same monster, IE, the same group of companies. When CF believe an IVA is unlikely to get approved with them or they can't charge what they'd like in fees, they'll shuffle it over to Logan Whyte who charge less. Both ar...

It's worth noting that Vanguard and Debt Movement aren't linked in any way. Vanguard IVAs are serviced by Ebenegate, who have close links with Creditfix. Ebenegate are based in Mauritius. Debt Movement, formerly Jarvis, acquired Aperture in September 2020 and many of the original Aperture staff were...

Are HMRC listed as one of your creditors? If your IVA is protocol compliant, HMRC will first use any rebate to offset against your debt with them, and pay any surplus to you for you to introduce to your IVA. You will not be able to keep the rebate, and the normal windfall rules do not apply in this ...

Is it possible the debt was secured on a property and therefore not bound by your IVA? I've seen a few cases like this recently where Capquest/Arrow have bought old secure debt

The issue here is that when you apply for UC, tax credit debts etc are moved from being under HMRCs remit to DWP, and HMRC being HMRC usually fail to mention to DWP that the debt is included and therefore bound by the IVA. When this happens, HMRC send you a letter called ‘Your tax credits overpaymen...

I'm so sorry to hear of your husband's ill helath. You'll find it difficult to obtain a mortgage with the IVA still on your credit files, and it'll be on there for A period of six years from the date of approval even if it completes earlier than expected. I'm no expert on mortgage issues, but there ...

If your IVA is protocol compliant, any rebate due to you from HMRC should really be dealt with as follows; 26. Set-off of repayments Any repayment due to you from HMRC relating to a period before the arrangement was approved shall be applied firstly against the HMRC claim in the arrangement. Any sur...

Is the charge from the creditor listed as interim or final? And does the charge pre-date the approval of your IVA? If so, it may well be that the debt is/was secure and therefore not bound by your completed IVA. It may be why they never claimed, as they benefited from having that security. I would b...
