You certainly aren't alone in this situation, any experienced debt advisor speaks to dozens of people who have done this. The key is to stop doing it now and take action to deal with debts - exactly as you have done.

Even harassment is an offence under s40 of the Administration of Justice Act 1970 but extortion and blackmail would certainly require police attention.

Anyone with a consumer credit license has to behave in a fit and proper way or the OFT will cancel it (yes they can and yes they do).

The 3rd week in January is always busier than the first.
However in the quieter times I find you get the more desperate cases.

I was a bit suspicious when they snuck it on on New years Eve It confirms that banks can still enforce debts even if the original agreement has been lost or destroyed. The ruling may affect thousands of potential cases gathered by claims management companies. "It seems to me to be likely that the nu...

If you are talking about loan to value and remortgaging in an IVA. £107,000 divided by £131,000 times by 100 is about 82% loan to value. There is only a very small amount of realisable equity in your property and the costs of remortgaging would swallow some of that. I doubt it would be in anyone's i...

As far as I can see full regulation will be in the favour of creditors. It will tie the hands of debt management advisors. The government should have gone with the SIVA proposals and limited the ability of creditors to refuse IVAs, your best offer is your best offer... Next thing will be modificatio...

I drove across Lancashire today to get to work and I didn't think i would make it. I stopped for petrol and nearly turned back. I wish I had! I'm on my own - my car is is the only one on the car park and there are half a dozen businesses sharing it. It was 8 degrees in the office first thing. There ...

You'd think the "Debt Management Provider of the Year 2008/2009" and a member of the DRF would be a bit more concerned about their reputation.

Thats a lot of questions - and you'd be better off speaking to someone and giving them the full picture. I think you have the right end of the stick - and I can re assure you no one is coming out to your house (unless you invite them!) IVAs are individual but some IPs present them as "interlocking" ...

Mitchell Farrar were a mortgage broker, its possible that in the credit crunch they have moved into insolvency work. Several other firms have. I just googled them and they appear to be recruiting an IP.

Yes, if you "qualified" for an IVA it would protect you from your liability for that debt. Getting an IVA agreed isn't a given and you need to get some professional advice on whether it is the best way to proceed. How would you fund an IVA if the business is in trouble? If the debt is initially owed...
