Principle 4 of the Data Protection Act 1988 states Personal data shall be accurate and, where necessary, kept up to date. Try advising the bailiffs that their data is incorrect and if they keep bothering you, you will notify the Information Commissioner. That's what I did in similar circumstances an...

Melanie, The IVA company have not suggested that I do this. I made the decision myself based on the genuine fact that I do have to retire for the reason specified. Accordingly, I need/want the IVA to end rather than it drag on. My pension options are lump sum + half pay, or no lump sum and 2/3 pay. ...

Thanks Melanie. I was concerned that if the creditors were not approached, they would see the pension as a windfall. He assured me that this will not be the case. Our original debt was £78,000. In October this year we will have paid in £35,557.00 'monthly scheduled payments' and an additional £2,319...

We are looking to settle our IVA this year. We have been in it for 2 years and it was scheduled for six. Owing to my wife's ill health, I am having to take early retirement in November and will be able to make a 'full and final' payment offer from a pension commutation. At this time, based on our cu...

Without seeing the proposal and the modifications it is hard to say for certain but I would find it difficult to see why creditors would not expect 100p and that would mean you would have to pay the IPs fees an top. If the retirement age and therefore pension can be deffered you could make the offe...

Melanie, you misunderstood. My pension (commutation) will be £90,000. I was expecting to pay about £45,000 of this as a full and final payment to settle the IVA. The rest was going to buy a caravan and car to enable my disabled wife an occasional holiday. At the moment, I am paying about £3000 more ...

Right, you have me worried now. I was expecting to have to pay about £45,000 to settle the IVA based on the starting figure (£82,584) minus what I will have paid at the relevant time (£37,394)Is it likely that they insist on 100p/£ plus fees because I get my pension? (which will be about £90,000)The...

My wife and I have been in a joint IVA for 14 months. We owed about £78,000 and the IVA was scheduled for 72 payments at £1,147 = £82,854 I can soon retire and our plan is to pay it off with a full and final settlement at the end of 2010. However, I have spoken to an independent financial advisor (t...

Sorry, should have made it clearer. The £200 is the total for the last 6 months. I guess they will do this every 6 months as that is how often I have to send payslips. My IVA is 100p/£ because 'Egg' would not accept anything less. All other creditors accepted the initial offer of 75p/£. None of the ...

My IVA is a 100p/£ paid over 6 years at £1147 pm. The total amount to be paid equates to the whole debt PLUS fees on top. I am 8 months/payments in. I have explained the the IP company that I can take early retirement in November 2010 owing to wife's ill health. I intend to make a full & final settl...

If you pay over your overtime it will mean that the IVA will be finished ealier as Viki has already mentioned. Why would you not want your IP to see your wage slips? It's not that I don't want them to see them I am merely wondering about the legalities. I am considering BR within the next few weeks...

Ah, I wish it was so simple. We owed Egg about £30k but a company called Grant Thornton voted on Egg’s behalf and Grant Thornton also represented some other of our creditors. Accordingly, Grant Thornton had the say. Some of the other smaller creditors had already accepted the initial offer.
