Topic: Would a F&F offer mean paying the full amount or the remaining balance

I guess each case is based on its individual merits but to me the uncertainty of life would mean that creditors shouldn't always expect to receive the full amount of remaining payments as a F&F. 30 months is a long time after all, and surely it's more attractive for creditors to have a lump sum now ...

Whilst I know it's only a guide the monthly repayment x months left F&F calculation worries me... I've been in an IVA for 49 months now, originally set to repay £36k during my IVA, but have already paid back just over that amount. Have missed 4 payments in last 12 months and IP extended my IVA for 4...

It sounds reasonable to me in the circumstances. My F&F meeting is set for 30th October. Original dividend was 54p in pound, but as I was restored to a 5 day week in June 2011 I've actually already (as of today) exceeded that, despite recently missing a large chunk of 4 payments, as a result of whic...

Strange, I've been with O2 for over 10 years, been in my IVA for over 4 years, in that time I've had new phone contracts, upgrades, signed up to their broadband service, never had any problems. Only difficulty was when I wanted to sign up to their line rental and they had to do a credit check, which...

Anyone going to try to convince me that my IP has my interests at heart ? - amazing how quickly they do a I&E review when I get a salary increase so that I pay extra money as soon as I get paid, but when the boot is on the other foot there always seems to be some reason why I should try to 'struggle...

As I've posted previously, it took my IP 5 weeks to send me the documentation for me to sign to authorise them to convene a creditors meeting regarding a F&F offer. In the last week I have received a tax code change notice from HMRC, which means an immediate reduction in my income. The amount isn't ...

Also just received my F&F offer paperwork from Payplan and it contains the same statement about the £500 charge for the variation meeting, but, as others have said, this will come out of the monies paid towards your IVA. Timescale wise once Payplan get your paperwork they approach your creditors for...

Anyone !?!. Over 4 weeks now and still nothing - chased up my IP by email yesterday who had the audacity to suggest that we were a long way into the F&F process. I pointed out I still hadn't received any paperwork to sign to enable my IP to convene a creditors meeting and asked if it had been sent o...

Thanks, I am becoming increasingly exasperated by the time it is taking to actually progress my F&F - it's now 4 weeks today since my IP confirmed that my F&F offer could proceed but I'm still yet to receive any paperwork from Payplan for me to sign so that they can convene a meeting of my creditors...

How long should it normally take from your IP confirming that it was happy to present a F&F offer to your creditors on your behalf and you actually being provided with the relevant paperwork to complete in order for your IP to convene a creditors meeting ?. As of tomorrow it will be 4 weeks since my...

Country Girl, Generally I've found Payplan (as a company, not in terms of my Case Officer) to be more "difficult" the longer my IVA has lasted. The whole issue of the legal basis for demanding 50% of any surplus (there's absolutely nothing in my IVA which they can rely on to demand this specific per...

I think the short answer would be yes. However equally much depends on the exact wording of your agreement with Payplan. As I have repeated on other threads, there isn't any express reference within my agreement where it states that I have to give Payplan 50% of any surplus income, except from a mon...

I'm in the midst of a F&F at the moment and not particularly impressed at the time is taking... So can anyone from Payplan actually offer any clarification or legal basis for demanding 50% of any surplus income APART from after a month after an annual review ?. Ironically enough when the boot was on the other foot, i.e. when three months before my annual review I received a much larger quarter...
