Yes thats true Melanie, its still very early days. I however wrote to everyone immediately after my bankruptcy order was granted and sent them copies of the court documentation in an attempt to stop the letters / phone calls as I find them so distressing. It hasn't helped but I know in time I will a...

Yes, you're right Kallis - the charging order is completely meaningless if someone is bankrupt. I got an "apology" letter from the law firm involved, however I am now considering telling them to pay the court fees etc as they have openly admitted that they were wrong to go to court (esp as they had ...

What upsets me most about these cases that go to court even after bankruptcy is that I now have to add the court fees etc to my debt, and I feel that its a little unfair (both to the court and to me) that more costs are being accrued when its been made perfectly clear to all involved that I am not i...

I am sorry for not keeping you all updated over the last few weeks. I had my interview with the insolvency office on 17/11 (my birthday...) and it was absolutely fine! I didn't sleep and was really scared but he was lovely and just wanted to understand my financial position without judging etc! Sinc...

Thank you Melanie. I am still astounded at how much time you, and other IPs invest in these forums. I agree that people often respond better to others in similar situations to their own, but I really do hope that everyone out there going through any debt problems appreciate the time and effort you p...

I cant imagine how difficult your job is Melanie, it must be heart wrenching to be seeing debt destroyed people day in day out! But I hope that when you see them get their lives back (as debt really does take everything away from you, including the joy of actually living) you get some solace from th...

I spent more time with the district judge than anyone else who was there today. Largely because i work for a law firm that he is very familiar with, but in that time he gave me a lot of great advice about how to handle creditors who continue to persue me, and the threatening letters etc. I'm going o...

Well I have done it! I have just got home after spending hours in my county court - mostly just waiting around! I am officially bankrupt now and to be honest, its a relief. The things I knew but are worth saying again... it's a serious as I thought it was going to be! Its a big deal and I'm glad I s...

And I think another point you need to consider is that people, like myself, who are facing these agonising decisions take EVERY OUNCE of courage to contact someone for help, be it CCCS or PayPlan or whoever they feel can help them best. Having to go through all that again if/when they feel that advi...

Well the good news so far is that Northern Rock have happily agreed to my suggest payment plan for my arrears. I have decided to go with the bankruptcy option and am going to my county court tomorrow to file my papers! Thanks again everyone for your help. I'll let you know how I get on. :-)

Thanks everyone, your help is invaluable. I have recently started talking to CCCS (this week) but its still in the very early stages and they haven't yet given me any advice regarding IVA's or bankruptcy as yet. You've all given me a lot to think about, and I'm very grateful for your help. It seeme ...

Thanks for your replies. PayPlan said that mortgage arrears were not allowed to be included in my expenditure budget. After all my essential bills were accounted for they were leaving me with £300 which had to pay for my mobile phone (non essential) and broadband (non essential even though I have to...

I have been trying to get advice for a few months as to whether an IVA is better for me or if I should go ahead with bankruptcy. I have a mortgage (there is less than £2000 equity in my flat - if that as the current market is not good). I have unsecured debts of about £60k and my o/s balance on my m...
