Skippy, I direct clients to the IVA forum on a daily basis. This is because I believe the advice and experience which can be shared on here is vital to anyone new to the insolvency industry in general. My concern is with a limit proportion of posters and members and there true intentions on providin...

I agree with DJG1405. RayB, in response to your comment, are you stating that the disclaimer on the site is providing false information and IVA.co.uk DO NOT receive any finacial reimbursement for clients who gain contact with one of the 'approved companies' via the medium of IVA.co.uk? I find this d...

Key thing to remember is Bailiffs are officers of the court, and as such can only be appointed by the courts. This means for any normal consumer debts you need to be at CCJ stage minimum before the courts will instruct bailiffs to enforce the judgement/order. Any creditor who advises you they will i...

Hi Rayb, You should check the T&C's regarding settlement in your proposal. Usually companies will allow themselves three months for 'bookkeeping' upon settlement of the VA. A common cause of delays to completion is creditors failing to cash dividend cheques, as your IP cannot complete your VA until ...

Hi Robert, I would request that Santander send a copy of the agreement to you, showing your signature. In response, I would also send to Santander a copy of the agreement that you currently hold. Also, it may be worth checking your credit file to see if the debt is registered as a loan or a HP agree...

Thanks Rob, Based on what you have told me it sounds as if they have no right to repossess your vehicle. It is possible that Santander beleive the debt you had with GE money was a HP when it is actually just an unsecured debt. Santander have as much right to repossess your car as I do! Your IP needs...

Hi Antm, Your creditors or IP have no right to insist you carry on working overtime. Your IVA has been proposed (i assume) using your guarenteed monthly income. This is to ensure you are able to maintain your payments comfortably. Often, individuals will work lots of overtime immediate prior to prop...

On the agreement, it should have a section headed 'Repossession: Your rights'. Does it state in here that they have the right to repossess before a certain sum has been repaid? The Santander/GE Money crossover is one of the particular area's of difficulty in the HP field at the moment. My IP will no...

Hi Karantiggy, I am sorry to hear of your present difficulties. It is unfortunate that your husband has left his employment, and I would assume this entitles you to a variation review on your arrangement. However, as the income has ceased completely I would assume that, as you say, it is going to be...

Hi Robert, The answer to your question really depends on whether the money owed for the car is a fixed-sum loan agreement or a hire purchase agreement. If the loan is a fixed sum loan agreement then the creditor has no security on the vehicle. This means that they would not be able to reclaim the go...

Hi Richard, The answer to this question will very much depend on your proposal. If your proposal has been prepared to the IVA protocol conditions, the remortgage clause should only be applicable if you are able to meet the criteria, i.e. you may not be offered a remortgage, you may not be able to ma...

Hi guys, I work in the insolvency sector and have been visiting this site for, if my memory serves me correctly, 3 years now. As the years have passed and my knowledge has increased, I have not visited as much as I did in my earlier days. My concern after reading a large section of the more recent p...

Are residents of Guernsey able to utilise solutions from the Insolvency Act '86. I.e. can a Guernsey resident declare UK bankruptcy or enter into an IVA.
If not, what options are available to the channel islands?
Thanks
