Can a charging order be gained for a property in negative equity? What if I go BR can they still apply for a charging order?

My return isn't too bad. Its the best I can offer anyway considering my I&E. If they disallow the school fees, I would look towards BR and then they would get hardly anything in comparison to an IVA.
