If your debt was deliberately left out and was not an oversight you could demand that the IP deems this to be a material irregularity. As Foggy says a lot depends on the size of the debt as to whether it is worth proceeding down the legal route and potentially costing yourself more.

You should engage with the debt company and then provide details of the IVA. Some student loans were included within IVAs for a time so your IP should be able to tell which ones were included and received a dividend and which ones were not.

If there is enough equity you may even be able to settle the IVA even though it has only started. A rental property may be more expensive than your current mortgage so your ability to pay the IVA could be under threat.

It is also very expensive to get out of bankruptcy as the costs alone could be in excess of £10,000 already. Unless you have substantial assets then it may not be worth it as by now there will be the fees to the Trustee in Bankruptcy ]TiB], the Official Receivers [O.R.] and the petitioning creditor....

Lisa and Foggy are spot on. Email your IP directly with an official complaint as being passed from pillar to post is not good enough.

Bear in mind that had you not been in an IVA any extra money would have all gone to repay creditors. This allows you and your creditors to benefit and think of all the extra cash when the IVA is over. It is also likely that you do not need to increase payments until the annual review stage so you sh...

That is great to hear and sounds like a very good company that you work for. Hopefully the last few months of your IVA fly by and that will be everything behind you then.

You could get confirmation from CF that the restriction should have been removed and this may help to move the sale forwards. However if the property has not been agreed for sale yet then it would likely be better to just wait. It does not take long once the RX4 is submitted.

I have seen some instances where other creditors have allowed a guarantor loan to be paid. However this case seems very odd as if this was the case then why would Amigo have a problem? The other issue would be how can your friend afford to repay this loan and an IVA?

You need to check and make sure you were liable for this increase as sometimes modifications can be outvoted. If this is not in the Chairman's Report then you are entitled to question whether or not the resolution was even passed. £100 seems a huge uplift and if certain expenses are outside the guid...

Your partner does not need to provide proof of their income so I suggest you try a different firm. Some companies will try and take his money to pay your creditors which is wrong.

I agree with all the comments. Bear in mind too that the promotion could lead to additional responsibilities, more clothing/dry cleaning costs etc. Do not turn down this chance as at worst you will increase your payments by half of the net increase after any additional costs.
