I would be surprised if an IP left out a debt for voting purposes if they knew the debt was guaranteed and already in default. I know some firms have tried to exclude debts on the grounds the creditor rejects but this would mean you would have to maintain the contractual payments if the other credit...

FJ usually get a good press on here but all firms have their problems. I would suggest a case review could be the answer before going down the formal complaint route. You could request a meeting with them and perhaps with everything in front of you there could be a resolution reached. At least you c...

There are certainly some inconsistencies within protocol and your IP will have to make a decision on this. For example, within protocol [so check your proposal] it states that the debtor will always retain 15% of the equity. Therefore in interlocking proposals where it says I will always retain 15% ...

I would think Aperture will be careful about failing any DFD cases until they have the full caseload migrated across to themselves. However this does not stop you from being nervous and you did the right thing by contacting them. I am sure you will be fine as Aperture have a track record of taking o...

Your figures seem to be wrong somewhere. If there are 43 months left at £1850 between you this means there is almost £80,000 to repay even without any extension or equity release unless the payments are due to reduce. Can you explain why you think there is only £50,000 left to pay.

Congratulations and well done to HB. Rather than just terminating the proposal they put your case to creditors and got the perfect outcome. Don't worry about completion certificates and insolvency registers today but instead enjoy your first day of debt freedom. The other things will fall into place...

I would also be happy to be involved in such discussions. If there are ways in which we can improve our service to clients it can only be a good thing. However there are times when things are beyond the control of IP firms and in these instances better communication from us to our clients would no d...

I cannot comment on the Debt Company either as not a name I recognise. However I have been told that Stepchange are reluctant to look at any cases where there is self employment which would encompass a buy to let. It is not complicated but some firms do not want anything to do with cases that involv...

Good luck from me too and I am sure your IP will be doing their best to get this accepted. I cannot see why creditors would reject so fingers crossed.

We are delighted for you Amy and you can now move on. Once the funds are paid in we can move to close the file and notify the Insolvency Service. However as the others have said your credit file will not be totally cleared up for six years from the start of the IVA regardless when your name comes of...

You should not be able to complete the sale without the IP removing their restriction. If they did not put one on the property then they could still stop the sale with a court order to prevent you leaving with the money. If you did sell and manage to get away with the money [which I doubt] there cou...

Send the request in writing directly to your IP and they have 21 days to call a variation. Four months is way too long and you should not be fobbed off.

A DMP could be prepared based on the IVA documents as I assume these were correct anyway. The IP would have checked your income and the level of debts so the only change would be the way the payments are made. CF should likely return your documents now the IV is rejected so if the DMP company needed...

Your first post said you did not want to lose your home and business so I assumed this meant you were self employed. However even if you are not an IVA may be possible if you equity but it depends on how much and which creditors you have. If there is sufficient equity in the property to repay the de...

You can contact someone like Stepchange or you could contact a fee-paying debt management company. Alternatively you could contact the CAB and administer one yourself so it depends on what you think would be best.
