That is a pity and I see from the other thread that Stepchange have advised bankruptcy. If there is no equity this could be the way forward otherwise a DMP for a while could be best.

A DMP sounds appropriate at this time and in a few months when the dust has settled you could propose another IVA. This is actually a lot more common that you might think and we regularly propose IVAs from debtors who have existing DMPs.

Given the urgency perhaps the CAB may be able to prioritise the application. I would suggest speaking with them again and explain about the bailiffs and how she needs protection now.

Creditors have been known to change their minds if the IP agrees to reduce their fees or the debtor agrees an extra year for example. Hopefully your IP can reach an agreement with the creditors even if it takes an adjournment of a few days.

Any share deductions would usually show up on the wage slips so if this the case it probably should have been picked up before now. It does depend on which creditors you have as there are differing criteria. However if your IP is satisfied that you have stopped gambling and is recommending this to creditors then an IVA may be acceptable. Should not be a problem at all. Just be careful to let us know when everything has been transferred across as we do not want old creditors to get an idea of the IVA until your wages etc are entirely safe. Let us know the minute you are confident all is ready.

As soon as we get the information we will progress the case so it should be drafted before the end of the week. We then email it to you for electronic signing and immediately then summon the meeting of creditors. I would say three weeks should be the end of it. Fingers crossed.
