This does not sound correct. The IVA should have been varied to accommodate increased creditor claims, and to serve someone with a Notice of Breach for such occurance makes me very surprised. Of course, they may be circumstances which have led to the Supervisor deciding on his actions, and therefore...

Very odd advice for an insolvency practitioner - tasked by creditors to ensure a maximum return - to provide! Is there any reason for this - ie is your business struggling, and is it the business which is generating your income to fund the IVA contributions?

Paid accounts like the Thinkmoney account will not allow you to go overdrawn - which is probably a good thing whilst in an IVA and living to a tight budget. You could also look at the Secure Trust account or there is another good one provided by ClearCash.

Did you both take out the IVAs at the same time, and do you just make one combined payment or are there two separate payments? I doubt that Payplan will see this as a failure point. Annual reviews are there to capture increases in earnings, but unless the increase was material in comparison to your ...

Hi AB and welcome to the forum The Interim Order cannot be voided as such, but even with the protection afforded by one a creditor can still continue with legal action against you if they have leave of the Court - they would, however, need to let the Court know of the existence of the Order in the f...

I will look at this for you Nichola, but I cannot really get involved in an issue between yourselves and your IP. I am an IP in practice too - and it is not really ethical for one IP to appraise the work of another - that is the remit of our regulators if there is an issue which cannot be resolved d...

No they cannot - so query why this has been sent to you, and get them to confirm their error.

Nice to see common sense prevailing at last - although heaven knows why this simply issue took so long to resolve for you Helen. Well done for sticking by your guns and being persistent - we all knew that was the right answer all along!

Are the IVAs interlocking, or are they entirely separate arrangements? Is her IVA likely to fail, or is your question merely hypothetical, Mark?

That would depend on the reasons for them having been left out of the original proceedings. If this was due to genuine mistake - and I wonder why that would have been - then it is possible to argue that they are bound by the terms of the IVA, and if so then the shortfall can be included as an IVA cr...

I don't think that 4 weeks is at all unreasonable, especially if our clients have to provide information to support the need for the variation. The 28 day period is a contractual requirement in most cases, and that timescale is therefore unavoidable.

You should receive this within two month of the final anniversary of your IVA paul, unless there are grounds which would prevent your IP from finalising matters by that time - such as ongoing PPI investigations, or reworking of dividend payments due to PPI having been set-off.
