I am still not sure if drawing down on your Pension can be claimed under the "Windfall" clause.

You pension was an assess the IVA had already agreed to exclude.

DO NOT go insolvent unless you have to. Use 20k to reduce you debts, if you think you would then be able to manage the remainder.

I don't think it is that clear cut and certainly could be tested in court. I think the contract could easily be judged "unfair" if there is an open ended commitment.

Certainly in my proposal the term of the IVA is referenced at least twice as being 72 months.

Same boat as you NurseCrippen, after 6 long years I paid my final payment last Friday. Great feeling, although will be even better next payday when I have some money in my pocket!!

I don't think anyone successfully completing a IVA should be penalised by not getting high street rates.

I am not advocating this for anyone else but it is a question for each individual if they choose to disclose past issues that are not on their credit report.

It doesn't matter whether they have been updated monthly or not at all, or even what their current status is. As long as the default dates are roughly right, they will disappear completely 6 years after this date

The answer to your question is no. Although in your IVA you agreed to handover all assets, this is not enough to go to creditors. You will need to agree and sign an letter of authorisation, that they will need. Otherwise the creditors will not entertain them.
