Hi Chardonnay, at least its a start eh? Still take Ian's advice though.. I'm sure when Melanie gets back she can also offer advice especially in your area. Melanie's office is in Cardiff.

I think that all of us here know someone in Cardiff.... Ms Giles! I'm sure one of her team will be monitoring the forum and will suggest a local lawyer if they can't help themselves.

To illustrate the point I have been making, So far as Mercedes is concerned, assuming the agreement pre-dates your IVA , any shortfall will be bound by it, by law. Whether it was taken into account in the proposal by BE is another matter of course, but even if not that does not rule out a variation of the IVA to take it into account.

There are lots of ideas that need to be explored. Once the important matters have been identified and you have a game-plan for tackling them, things won't seem half as bad as they do now.

Thanks Ian - you are right there is £18,046 in my agreement for mercedes Benz, which covers the shortfall between current value and purchase price. I didn't want the car, but got talked into it as they sold one of Keith's company cars for me and I have to have a car for work, no car no job!!
The cars by the way - I didn't explain - Keith did the paperwork with the companies and I was bullied into signing for them so they were in my name. I have been told the ones with my name and his bank account details were not legal, but again I don't know and it's not worth much now they have been sold.
You are so right if I can get a plan together that allows me to move forward and know what's happening I will at least feel more confident in my ability to cope with the things life throws at me. My house drains have packed up and I've just had to get an emergency plummer - that's today's bad luck. (It's just one thing afer another - let's hope it's only one thing today and not several!!).

If you have signed the agreement, unless Mercedes were involved in what seems to be "undue influence" then I would have thought you might struggle with them. A legal thing though my initial thoughts on that are why bother if they are bound by your IVA anyway? If your sister can help you get a little runabout (assuming that's enough) then it seems you can just hand the Merc back and let BE deal with it? Unless I'm missing something?

If you were in Manchester I would know loads of lawyers who would be able to advise you, which is crucial in the circumstances you have outlined. Trouble is, I don't know any in Cardiff but hopefully someone from Mel's team will be able to give some input.

Hi,
Yes Ian that's my plan once I get the run around - hence my suggestion that I don't pay mercedes this month and use the £611 as part of the deposit money so my sister has to lend me less. Then when Merc take the car back they are still in the IVA payments with the £18,046. Does that sound reasonable?

Seems a sound strategy, so long as Merc hang fire on repossession till you get the replacement. Obviously the other issues you need to take detailed advice on.

I get the feeling you are already beginning to focus and see some light at the end of the tunnel. That's the way!

Hi Everyone,
Just a note to let you all know my doctor has confirmed I am suffering from Clinical Depression - made worse by the anniversary of Keiths passing and re-living the trauma of being unable to revive him (that's hard for a nurse as it feels like failure on my part). The money stress has just compuonded everything!!
I now have some medication and will be taking counselling.
If any one else (especially newer members) feel as I did - please see your doctor, I felt better just being able to talk to her and be told I would get through this. I told her how fantastic you have all been and how much it has helped,

Thanks for your kind words. This site is helping me so much, it's brilliant!! also may have found a friend who is willing to help with the car deposit, so all in all a couple of not so bad days for a change.
