Settled IVA in January (Still not closed)

Hi guys
I am just looking for a little information, i settled my IVA early January. Since then i have not received any correspondence and no fulfillment certificate.

Every time i call them they advise they are awaiting acceptance from one of the creditors, this should be no more than 6 weeks, if they have not responded they can can settle without their permission.

I called again today, They advised the same again (about 4 months on). They have also advised they don't want to close my IVA due to the VAT refund because i should be due something back.

I understand from other posts this is common at the moment but is 9 months normal?

Hi and welcome.

There are a lot of companies with delayed completion at the moment, some is to do with VAT claims and some to do with PPI claims.

I'm afraid some posters have been waiting over 12 months.

:( that does not sound good at all, is it actually legal for them to do this?

Based on the information that the creditors only have a set amount of time to respond, before its settled anyway?

With the PPI claims and the VAT issue then it is legal.

thank you very much for the information.

I have 1 more question you maybe able to help me with.

I believe this drops off my credit rating 1 year after completion of my IVA, is this 1 year after my settlement date or 1 year after my original fulfillment date (6 years)

Sorry if the above makes no sense will try again, i had my IVA for 1 year, settled it in full will it be another 5 year to drop off?

Hi Wilson and welcome, i do believe that it is 6 years from the commencement of the IVA however if it is still live as in you haven't received your CC i can't answer that one, hopefully one of the experts will be able to inform you of that, i would actually write to your IP and ask for a time frame to closure, good luck.

IVA COMPLETED August 2012, received Completion certificate 18.4.13.

Well i have spoken to them on the phone a number of times, Letter is my last option.

I think i will get on with the letter straight away.

Be firm with them and ask them to give you a specific date by which time your case can be closed. Case closures should not be taking as long as this to finalise.
