Your IP must return that money given the circumstances you are describing. Which firm are you using.

Its a firm called Bond partners. I dont find them particularly professional to be honest- they didnt offer any condolence at all when I called and said my options were get a job quick or go bankrupt!

I have never heard of this company. How did you come across them initially? And I am assuming that your IVA has not yet been presented?

I went to a company called lifeline debt solutions- who were local, very supportive and informative. They though have passed all my information on to Bond Partners- who are basically an accountancy firm.
My proposal was signed on Monday and the creditors meeting scheduled for feb 10th.
Do you think it is worth me trying to go the route of proposing a full and final even if its quite low?

You can try - they can only say no.

to draft a new proposal im guessing they wont return the £1400 already paid.
Im still a bit at 6's and 7's at the moment as it wasnt expected.....I think I need to sleep on it.
Though I am really reaching a point where I want to go BR or try and get a full and final even if small. Or I can see myself spending the next 5 yrs in constant worry of losing my job and being back at square one

Yes, try and get some sleep tonight and then spend the weekend thinking about things.

Don't forget that we're here even if you only want a moan or to ask anything.

That's all right! You come on as often as you want, someone's always around.

Did you sign anything which entitles this firm to retain your money? Was there an engagement letter which clearly identified what you would pay if you withdrew from the proceedings? And do you have the ability to offer a full and final settlement?

Personally, if you can offer an alternative proposal, I would withdraw from the current proceedings and find a more knowledgeable IP attuned with the requirements of the consumer marketplace.

Thanks skippy.....
My engagement letter states payments made to this practice in the period whilst we are setting up your arrangement will be utilised on account of the nominee fee. It doesnt seem to mention what happens if I withdraw, but I am guessing they will want payment of some kind for the work they have so far done.....
At the most I could get together £8000 - on a debt of £57,000 it doesnt give them a great return but would they rather that than bankruptcy??
At this stage I so wish I could go with someone else- but thats not an option if I cant get funds already paid back
