Generally, what would a solicitor charge to witness my signature on an IVA proposal - assuming I have to select my own solicitor?

You don't need a solicitor to sign your proposal - we had to get some one that was not a member of our family - we covered up the documents they were signing just leaving our signatures for them to witness against!

That's a new one on me.

My proposal was not witnessed by anyone. I most certainly would not pay a solicitor to do it. You just sign it and send it back.

Thinking about it -it wasn't our proposal that was witnessed - that was our wills ! No witness signature should be necessary !

I've just checked our proposal, and it was NOT witnessed by anyone, just has the IP saying that he had received it and was willing to act for us.

Phew! that's a relief.

I read somewhere - I think it was on this site - that a solicitor must witness the signature.

At least that's one less thing to worry about at this difficult time.

Can't see it having been on here. Someone would have come on and shot us down in flames!

You just sign the proposal, send it back and then let your IP take it from there. You should not have to make any payments upfront, other than perhaps your first monthly payment (some IP's like to have that ready).

I have sent a pre-dated cheque for my first month's contribution. I was told that it is a sign of good faith to the creditors.

I hope this was a wise thing to do and I haven't set myself up for a fall!

If it is for your first months IVA payment, that's fine, although a lot of companies don't ask for that.

If, looking on the black side, your application is rejected, I presume they will return the cheque to you?

I think that you are confusing this with an IVA where there is a need to obtain an Interim Order. If so, the affidavit to accompany the application needs to be sworn in the presence of a solicitor or Court offical. The cost for this at a solicitor's office is £7, but it is free of charge at Court.

I had my proposal last week and that had to be sworn at a solicitor- they charged £7 a signature
