Hi all,

I wont say too much right now but this company say they are going to take me to the high courts for Defamation of Character. Ive forwarded emails to Andy and am waiting on his thoughts. Sounds crazy as i was just asking an opinion from you all...this is a forum and its what it is for!

Ive tried to contact the MD of this particular company but he isnt returning my calls at the moment. Its very upsetting

I'm just wondering that as both of you received a letter originally from them then it may be that they keep records of that. It wouldn't take long for them to check addresses they had sent details out to last April and do a bit of digging.

That is only a guess though.

I think if they have tied a specific username to a person then they must have obtained confirmation from somewhere. I would contact them and ask them where they have got this information from, without admitting any liability of course.

Ive tried. They want a public apology or they will take this to the high courts...i will of course do that if it resolves the problem but i really didnt see i did anything wrong. I was just asking an opinion.

Just when my life was going ok this turns up.

I need to ask this MD how he would like this public apology issued.

I would assume that they would want the public apology in the same forum where the alleged offense took place. I would still be very concerned how they have confirmed beyond doubt that your anonymous username relates specifically to you.

It might be worthwhile getting in touch with an organisation that offers free legal advice. See the below link to the direct gov website page relating to this:

Hopefully with a bit of advice this issue can be resolved quickly.

Can someone who isn't being sued post the link to the thread...if I'm going down I'd like to know what for! Honestly, I'll write a note of apology for publicly airing a view if it means not going through the boredom of a court case.

Sounds like empty threats !! - however as Gareth has said it may be worth taking some advice - i would also check your house insurance policy, as most now offer free legal service as part of the policy

I think our own firms who post can sometimes know who we are from the details we give. When Liam posted on here, he worked out who I was and emailed me off forum about a query I'd posted.

I can understand if an Insolvency company can identify you, we keep a lot of your personal information and even then it is unlikely that you would be identified unless you gave a lot of specific IVA case details.

For legal letters such as these they surely must have cast iron proof unless of course this is just a fishing expedition and they are casting their net wide!

But who instructed the legal firm? Would they have held Pandy's and Geoffrey's details?

I found it earlier on Geoff was the OP cant seem to find it now. I was the second poster on it, think it was called Bankcrupcy assit firms
