Hi Viki, debtmountain. Thanks, it's not that bad to be honest now! I'm resigned to the fact that it's happening and I refuse to let it ruin our lives! There is always a way! Sorry to hear your hubby still hasn't found work either Viki. We did get a glimmer of hope last night though! At the mo he is doing part time work for his old employer and they have mentioned that in about 6 weeks they may have a permanent position for him! It's for a lot less money, but it is doing what he likes to do and is back in Bournemouth where we want to move back to and all our friends and a lot of family are! The only problems I see are having to move again and not being able to find someone to rent from! But feeling quite excited! Hope you get some good news soon too Viki!

Thanks Fergiedoggy, I was thinking of going that route. I also thought I might give our old letting agents a try as we left them on good terms and were with them for five years, so I think that ought to count for something!

Hi all!! Thought I'd post an update! Things have changed totally! We've just missed our 4th IVA payment which is now unauthorised! Did write to IP to let them know this would happen back in February, but haven't heard from them at all, so I've just e-mailed them to try and find out what's going to happen next. We are pretty much resigned to the fact that we are going to be going bankrupt though as things haven't improved on the job front! Hubby still just doing part-time work as he is bieng messed about by his boss! We have managed to renew the lease on the house we are in though for another year. Landlord understands situation and doesn't mind the fact we are on benefits etc, we just decided it would be too expensive and too much hassle to move, so hubby is staying with his mum when he works!!! Next step is sorting out trying to go bankrupt!!Lets hope I hear from IP soon and if IVA is failed I get the certificate or letter as soon as poss!

Hi jojo,

Bit of a bummer that your IVA is going to fail, but at least now you can move forward. You should get your certificate soon, if you don't, I'd just keep hounding your IP until they sent it to you.

Good news that at least you have an understanding landlord and have renewed your lease.

So sorry hubby hasn't got full time employment yet.

Once you get your certificate, you will be able to go BR as soon as you can get a court date.

In the meantime, you can start filling in the forms now online and save them as you go along, that way you have a head start. You can find them here:

https://www.insolvencydirect.gov.uk/isolv/

You can come on here and ask us if there's anything you don't understand.

Good luck, and don't forget to let us know how you are getting on.

I'm sorry to hear that things haven't improved for you jojo these past couple of months and that hubby has been messed around with his job and hasn't managed to find full time work yet!!!...but glad to hear that you have an understanding landlord and have managed to renew your lease, at least that's one less thing to worry about for you both!!.it's such a shame though for the IVA to fail after all this time!!,but if you have to go Bankrupt, then you've done all that you can haven't you, and I would just like to wish you lots of luck and hope that you get the certificate soon and can then move on with your lives as this must have been such an awful few months for you both!!..good luck and let us all know how you get on?..take care...xx

Thanks Kallis, Debtmountain. It is a shame about the IVA, but it's just impossible to pay it! The only prob we have now is saving up the bankruptcy fees with not much spare cash! We'll get there though! I got to the point where I'm refusing to let the situation stop me living my life and depressing me! We are just getting on with it and what will be will be!! We have a nice house and the kids get to stay at good schools they are settled in, which is what I am more concerned about at the mo. Hopefully though we will save the money and be able to go bankrupt by Christmas and I won't lie it will be a huge relief!!

I take it there's no provision in the IVA for funds to be put aside for BR?

Good for you jojo in not letting this beat you, you have a really nice positive attitude and like you say, there are far more important things in life and what will be will be with the debt situation...you've done everything you possibly can and I hope that you manage to raise the money sooner rather than later so you can move on and get on with the rest of your lives...I was going to say that if I win the euromillions tonight,I'd give you a chunk ( as well as a few of my other forum buddies of course too[;)] but forgot to buy one[:0] so unfortunately no chance of that happening,as if I would win though eh!!..anyway,keep in touch and remember we're all here for you...take care...xx[:)]...

Ha ha! Thanks debtmountain, but never mind! I think we're happier without money though! I find it funny that I finally realised this - and a few more of us on this forum, but the majority of people seem to still think that possessions and keeping up with the 'Joneses' is what's important! Then I think that they're probably heading for where I've been anyway!
Kallis, I can't find anything in my IVA documents saying that a provision would be made for bankruptcy, so I'm guessing there isn't one! They don't seem to be interested when they know it's going to fail anyway - well that's my opinion!
To both of you - good luck with your IVA's, before you know it you'll be half way through and then at the end! Yes there's a few high's and lows along the way and it's not easy, but it will be worth it!
