Hi all - well, I have a new court date for my bankruptcy petition - Tuesday 9th October![:0] I am absolutely petrified now. I am a maximum of 14 days overdue, but creditors are already calling me - one phoned 3 times in one evening.[:(] Now my Dad answers the phone and tells people I am away - I just can't cope with it at the moment. So now I just have two more days, then I will be in court. A question has come to my mind though - do they always declare you bankrupt? Or can they decline to do so?[?] I haven't managed to dig out all of my statements either - will the OR need these, and how long will I need to go back? Thanks for listening to me guys! I think I am driving my Dad mad![}:)] D.

hi douglass stop worrying the only way they would not declare you BR is if when asked if you have received professional advice you answer no!

on the day of BR unless you are seeing the OR on the same day you won't need to take anything other than the BR petition to the court, don't worry even when it comes to the Or meeting you don't have all the statements as they can get these from the account numbers, mine never asked for anything off me at all.

I'm glad that you haven't got as long to wait Douglas. Don't worry about not having all your statement - the OR can get them from your creditors.

It is highly unlikely that the judge would turn down your BR application. The main reasons he would do so is if he felt that you do not understand the implications of BR as you haven't taken advice, or that you are not insolvent - I'm sure you don't come into either of those categories. Kerri & Skippy - thanks so much. I haven't taken professional advice, except from here and my senior manager at work (I work for a bank!). I fully understand the implications and restrictions of bankruptcy though, as you all helped me on here, and my manager explained it all to me too. Do you think this is enough? Of course, Melanie also helped enormously too! D xxx

douglas like andy said just say you have sought advice and know the implications, for goodness sake don't say no, lol, they don't normally go into were you got advice from but if they do ask just say an IP melanie, it is all over so quick some in fact don't even get into see the judge, me and hubby together were all done in a matter of 5 mins really, you spend longer with the clerk who just checks the forms, gets you to swear on the bible and takes your money, and they are normally very nice and treat you with dignity.

Pippa, Andy, Kerri - thanks very much. I am feeling much better than I was before I logged on. Thanks so much! I am trying to look at bankruptcy as a positive step - the first step in putting my past behind me and moving forward. I just hope I have the strength to get through it now! D.

douglass you will be fine, ok its not a walk in the park, its your only way out, i went BR in april along with hubby after trying every avenue, we got early discharge in september we done 5 months of BR and yes you will start to move forward you will have days thinking what have i done, how did i get in this mess, but believe me once that BR is granted the relief is immense, ok we have to live with it, but you are not alone and you have stood up took your head out of the sand and admitted hey! i have a problem and i am going to deal with it.
i really wish you all the best for tuesday, it will go well and you will feel so much better when it is all over, good luck

Kerri - thank you very much - I know it will be difficult, and if I get a BRO even more so, but at the end of the day there is nothing else I can do. One of my main creditors is NR, who reject most IVA's - hence why I decided on bankruptcy. Thanks again. I will keep you all updated. D.

Good luck for Tuesday. As the other posters have said, its not a walk in the park, but its not as daunting as one would think. I have had my "interview" with the OR - 3 days after going BR - she was very pleasant and has only asked me for a couple of things which I can't seem to find no matter how hard I look!!!!

Hi Douglass when you go into the County Court Matey they are really quite nice and pleasant...and you will lookaround and maybe see 3 or 4 people, couples like yourself (i saw 7) with me they put us all together, never even saw the Judge we were all called into a room and got our bankruptcy orders and were told some one would ring us from the OR office, no BRO payment enforced kept my home after 2 months of sorting (got the letter 2 days ago actually) but the minute you get that BR certificate no one`s allowed to call, at least you can answer the phone after, and if it is them give them the order number and they will never bother you again.....written off all debt well done debt free woo hoo!!!! its an amazing feeling to be rid of... Believe me!! costing £475.00 lol Considering i phoned NR themselves to try and sort out payments this was 1 months payment and they rejected it ! and they wonder why they are in a mess?[:o)]

B word not as bad as you`d think ? (im gonna find out soon)Since found out and turned out great!!!
