Hi I Went bankrupt and discharged in 2009. There is no record of it on my credit file and it is not on the online Insolvency service register. I now have an excellent credit rating and have received a mortgage offer on a property I am trying to purchase.
My question is will anything show up on the K16 Bankruptcy search done via my solicitor? thanks

Hi,

It shouldn't do - were you asked the question as to whether or not you have ever been bankrupt?

Was not asked the question. Didn't even know they did these checks but when looking into it my mortgage company's criteria States "discharged bankrupts considered - minimum 7 years"

I'm really worried now as I am only 6 1/2 years. The application has gone through fine but I'm just worried about the solicitor k16 search

If there is still a problem then we do have two resident mortgage advisors on here - Ryan and Shaun so it might be that you need to have a word with them. Their details are under the expert link on the left hand side of the page.

What do you mean by problem?

The bankruptcy is gone, discharged, 6 1/2 year old and my credit is good.

Just unsure weather the solicitor check will scupper the mortgage and show the bankruptcy

I meant that if it flags up for the solicitor it might cause a problem - you can always speak to Ryan or Shaun if this happens.

Plus the lending criteria of some companies is that if you have ever been in BR they will never lend to you (and have no obligation to do so).
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

That is my question?

With the bankruptcy over 6 year old and everything accepted. When the solicitor does the final k16 check will it flat up and old bancruptcy.

Therefore, am I better to just proceed as everything is agreed or cancel and search for another mortgage?

It may do - it will also depend on which mortgage company you are using.

Is the k16 not a standard solicitors search which only goes back 6 years?

I don't know - some companies will go back further.

I think that is what I'm trying to decipher.

If the mortgage has been accepted, I would presume they have done all their checks.

Does the k16 search from solicitors after exchange only go back 6 years?
