Hi folks I have been served with the stat br order for the sum of 2.7K. I have been in touch with cccs who have put me in touch with a legal place who are looking at my case. All I have to offer has been offered so there is really nothing more I can do. To tell you the truth, everyone you speak to seem to want to put you in an IVA or charge you to go BR, I dont understand this. All I really want to do is pay my creditors what I have to offer and get on with my life. I cant go into a DMP, with no disposable income. I know there are professionals who make a living out of debt but I just wish they would look at the problems the person is facing first and foremost, then look at solving the issue. Sorry for the offload, its just getting to me, the creditors have made money out of me when I kept to my payments, without missing a single one for the last 27 or so years. Does anyone else feel like they fell from grace to a land of vultures?

Just from a practical point of view Vicky - how can you pay your creditors if you have no disposable income? Likewise how would you fund the payments to an IVA?

The very best professional could not find you a debt solution if you have no assets or disposable income. Let the creditor continue to make you bankrupt if that is what they intend to do, as at lest it will save you a fee.

I'm just wondering how you have managed to maintain payments on time for so long historicallys. Has something major happened to change your circumstances?

Hi Vicky ...sorry to hear that you are continuing to struggle. I hope that you find a solution soon ... perhaps you are just unable to beat the 'big boys'

Did you ever give Paul Johns (Reviva) a call ... it really would help you know.

I was given a small sum of money from my father, I became ill with epilepsy and can longer do my job, I am 45, also I cant return to my place of work with a BR against me. It was their intention to find me something I could do when I am well enough.

I am just getting a bit tired of being told, you have a lump sum do you? Hmmm, well we can certainly help with that, yes I know you cant.

I have looked at everything and spoken to a few IP's I dont have enough to offer an f and f. I was reading the forum for some time before I started to post. I spoke to CCCS today and all they kept saying was they could make something work, I know they cant, I have already tried. I dont think they are the same company now that they offer IVA's it doesnt seem to me to be impartial advice anymore, just my view though.

Melanie, I know you offer very good advice here whatever our circumstances are but not all are like you, they seem to want to make it work, a bit like when youre buying something, sales people keep trying to convince you you need this and that when you cant afford it. I know I cant afford any other solution than bankruptcy or the creditors getting 20 per cent in settlement. If they want to push it, they can, I just want to be enlightened about what is likey to happen and then I wont be scared of it all.

I dont care if the company make me bankrupt, it will end this. I just dont understand the legal speak document I have had today and I wanted to find out what happens.

Vicky ... Paul (Reviva) is pretty skilled at negotiated settlements which could be an answer for you.

Vicky - can you post exactly how much you owe to which creditors, and how much your Dad has given you, so that I can understand why the other IPs have turned you down. At the end of the day that money is going to be lost if you are made bankrupt in any case, and probably absorbed in bankruptcy costs, so it has to be worth looking at an offer now even if it is really low.

A return of 20p in the £ is probably acceptable to your creditors if you are prepared to give it a go.

Vicky ... my Full and Final offer went through at 20p ... the alternative being bankruptcy.

I had something like this happen when I had a lump sum offer. I was threatend constantly. Just dont let them beat you

Vicky, let them make you br and get their share out what they can from nothing!!
Please get in touch with Paul, he will help you take the next steps.
I wish our creditors made us br, we would have saved nearly £1000 in court fees alone!!!
