Step-Father needs help - advice?

It,s all about paying back as much as you can and if he increased his debt just so he could"qualify"for an IVA and have a large part written off by his creditors it would go against all you have said before.

Things like the barbers, clothing, sundries, medicines are automatically allocated by the CCCS on-line software - it was only after looking at it we accepted that if they gave the figures perhaps they are "agreed" across the board as fair to everyone.

I honestly don't know - and yes, he could purchase some clippers - but even at £15 the speed his hair is going he may be better paying £10/month at the barbers and using pledge after that LOL

Sorry - I wasn't suggesting he SHOULD increase his debt, I simply put forward the notion that he would be better off if he had £10k more debt.

I was expressing my shock at the way the system appears to work.

I trust you realise i was being ironic after some of your comments yesterday!

PS: He could always just let his hair grow long and look like a horse.

PPS: I hope this doesn’t turn in to a long thread about horses again.

That is why the SIVAS are being evolved for that reason.Melanies advice of a DMP and then looking to enter a SIVA when the time is right seems a sensible way forward for your father in law

Thanks for the in-depth reply.

I think he would certainly be better going for bankruptcy as he has no assets.

Personally (and don't shout at me please anyone) I think the restrictions it would place on him would really help him long-term. He just cannot get his head around using credit cards and the problem of maxing them out month after month.

Unfortunately, he is old and proud and is only considering the IVA route as he is unlikely to have to attend a courtroom.

Perhaps, as you suggest, it will be an idea to complete the CCCS forms and try a DMP first - then take a look at an SIVA or Bankruptcy next April or so.

If you cannot persuade him to go to Court, and please convey that in this instance he is going to Court because he wants the Court to help him, it is not a punishment - He is the customer in this instance! then a DMP would appear to be the only option at this point in time.

Hi Rob

Just back from the workhouse (lol) and glad to see the forum has been active in providing you with some solutions to your step father's problems.

I for one will not shout at you for implying the restrictions might do him some good. Many of us on here have vowed never to have another credit card again. As I stated in my previous post to you lots of people come on here in search of answers very early in the process and often ask such things as "how long will it take to repair my credit rating" or "why can't I have a holiday?" These questions are often answered with some home truths about the fact that an IVA is not an escape from our responsibilities to repay our debts but is an opportunity to have a final outcome whilst paying as much as we can afford over 5 years. Maybe when we reply we are not so blunt as you came across in your earlier posts but then we are also sinners and cannot therefore cast the first stone. Whereas he without sin.......

Anyway, bad starts aside I would like to say hi and welcome to the forum. Many people here choose an IVA over BR because they want to do the right thing and pay as much as possible to their creditors. Others choose because they want to keep their property - albeit with an equity release usually at year 4 which will increase their mortgage payments - and others still due to their career.

Your step father can do one of two things.
1. Not worry too much about the creditors and go BR. This is by no means as bad as he may think - other than his name being printed in very small print at the back of his local newspaper - and I would suggest you read Skippy13 and Scaredkez' blogs regarding this. This would cost him £475 to petition his own BR.

2. Go into a DMP with a view to doing a SIVA when they are available next year.

Good luck with whatever he decides and post again if you need further assistance.
