I am sure that McD will put the strongest case forward for you. It is in no one's interest for your IVA to fail, getting the f&f will, I'm sure, make life so much easier for you and your family, good luck.
Last Payment made 04/12/14. Completion Certificate 25/7/15. IVA company GT. No Issues
So long as you can properly demonstrate that you can no longer afford to make payments, it is in everybody's best interests to simply close down the IVA on the basis of payments made to date in full and final settlement. This assumes that you have no assets which could be made available to a subsequent Trustee in bankruptcy if your variation were to be turned down and creditors petitioned (which is probably unlikely).
What are assets? I probably sound really thick asking that but I've never been in this position. Is it like a house/car? We have neither of those and we certainly don't have any savings.
And thank you everyone else - fingers crossed this works!
Assets would me your home and car.
as you rent your home, there are no assets there and your car if it was worth £1000's which I bet it not.
Good luck with your meeting and any ? ask there is always some one arould to reply.
IVA now over with and it was worth it.
now starting my life again,
To be honest, we've sold just about everything we can including a bunch of my youngest daughters old clothing. Had a good clear out - still got a washer and a moses basket though if anyone is looking ha ha.
Is it likely that the creditors will go that route?
I would hope that with all the changes you have had to endure, and the fact that your husband has completed over half of the term creditors would consider any variation to conclude the IVA in a positive light.
If they can see that there is no way payments can be met, what is the point in rejecting the proposal? Your husband is with a fantastic company (I have nothing but praise for the way they dealt with our IVA) so if anyone can do it, they can.
Good luck Seventh - hope you get a positive outcome and can move forward. Hope you don't need to sell anything else and can manage until the IVa is concluded...then sell the moses basket for a good price and use that to have a treat. Best wishes
