Yes that is the case so the Student Loans will have to be paid outside bankruptcy and IVA's once the legislation is enacted. This will possible kick in based on a peersons salary which will reduce the DI in respect of future cases for IVA's!

Thanks for all of your responses. My IVA meeting is due next friday (student loan included, so I'm expecting a no), but I now have the added problem of being signed off work with depression. I'm not sure if I'll be able to return to my job, and may have to take a lower paid position which would mean my IVA fails before it's even started. Not sure what I would do then - part of me wants to avoid bankruptcy, part of me would be happy to get the debt out of the way sooner. Any advice? (have contacted my IVA person and am waiting for a reply).
You must inform your Nominee (IP) the change in circumstances. Postpone your IVA until (a) you are back at work (b) start a new job.
You must think positive and sort yourself out medically - from that point a debt solution will be possible.
Until your income is known or stable the IVA route might not be appropriate and a temporary debt management plan might suit. The alternative is bankruptcy.

I can imagine that it is difficult situation you are currently in. Two years ago I started with forex trading http://fntn.com/forex-trading-easy and unfortunately now I must also apply for an IVA in order to avoid bankruptcy. This is currently also a difficult situation for me. It would be very interesting to know what you did at least with your student loan. Hope everything worked out for you.
