student loan on 2003 can it be included in iva

I took a student loan on 4 Oct 2003. I owe £5000. Can it be included in IVA. It`s income related for repayment purposes.£80 pm at the moment

Hi ptn and welcome to the forum

Your student loan should be included within your IVA proposal, however this company are generally rejecting all IVA applications at the moment so if they represent more than 25% of your overall creditors this may result in the IVA being rejected.

It may be possible to exclude the loan from proceedings, but this can only be done with the express agreement of your other creditors, as this is effectively preferring the student loan company. Your other creditors could take a commercial view whether this is an appropriate way forward for them.

And you are no doubt aware that student loans cannot be removed within bankruptcy proceedings.
