I am confused. Is there a meeting of creditors called and if so for what date? The IP does not need to wait on any creditor to vote as some do and some do not. HMRC often abstain from IVAs where they are a small percentage of the debt or where they are busy and cannot vote on them all.

If there are sufficient votes on the day without HMRC then the IVA is approved and HMRC are bound by the outcome. You need to find out if there is actually a meeting taking place at all as this does not sound right to me.

Have you received a copy of the proposal detailing where and when the meeting is to be held?

The hmrc are the biggest part of the debt, I've not had any paperwork about the meeting, I have just been told that they are waiting for a desicion from hmrc, I'm completely confused myself as to what's happening and they said hopefully we will hear in the next few days.

I suggest you contact whoever is dealing with this and get some clarification. If there is a meeting you should have a copy of the proposal and a date but as you have neither I am suspicious that someone is not telling you the entire story.

HMRC used to accept mini proposals and would give a view on these but now they prefer the proposal is circulated and a proper meeting called. In too many instances HMRC were doing the work anyway with regards to the mini proposals so they may as way have the full document.

You need to speak with the IP dealing with this and make sure there actually is one and you are not being strung along.

I have just messaged them asking if there is a meeting and he messaged back saying hmrc used to not vote but now we are waiting to hear if they will..

I'm starting to feel like I'm being messed about a bit. I'm not really sure as to what to do next.

Does not sound like a meeting has been called at all so has there even been a proposal drafted? This idea that HMRC 'used to not vote' is nonsense as they sometimes they vote and sometimes they do not. I have been in this job over eighteen years and dealt with HMRC the entire time and they have always been the same. They often abstain when they are a small percentage of the debt as their vote would be unable to influence the outcome of the meeting.

Are you actually using an insolvency firm and if so have you ever spoken to the IP?

Yes I'm using an insolvancy firm, they sorted out a friend of mine too but in super fast time compared to me, I feel like I'm put on hold and feel like I'm just getting simple answers to my questions rather than explanations, meanwhile my husband is struggling with an aoe at a high rate which is putting us further in debt, I just don't know what to do

You need to find out what is going on or consider going elsewhere. Ask to speak to the IP because if you cannot do this now it does not bode well for the next five years.

I'm definitely already thinking of going elsewhere, I'm going to get my husband to call them as I seam to be getting nowhere. So we will see what they say to him. Thanks for your advice,

Yes its called Peretto, I'm now even more confused as now they are saying they are waiting on someone else's outcome with hmrc before putting mine forward, not quite sure what difference someone else's outcome has to do with me, it doesn't mean their outcome will be exact same as mine does it?

I have looked for them and cannot find them anywhere. Are they introducers ? They are not listed on the Insolvency Service site, as far as I can see.

It sounds to me like an introducer firm who are trying to find an IP firm who will take on the case. Many firms will not deal with cases where HMRC are a major creditor as they have different criteria to the banks and reject a larger proportion of IVAs. Go direct to an insolvency firm and get some free advice and hopefully you can get the result you are looking for.
