just cant believe that they seem never to have come across this before! In a way if i do have to hand it over it will be like paying twice, overpaying at source then paying more out of what would have been my living expenses anyway. Still no answer from the IP.

My IP's assistant finally got back to me. It seems that my tax overpayement is classed as additional income so the 10%/50%/50% rule applies so the good news is that i can still hold to a chunk of it.
Perhaps this is my first good thing to happen out of three this week!! Tomorrow will find out if jobs safe and who knows lottery win on Saturday??

What a shame your IP could not take your call! I am sure she would have been able to give you an answer, and sorry I don't agree with the advice you have been given - but if you are happy so be it.
not happy about it, but a proportion of something is better than nothing. I argued my point as much as possible with the assistant before emailing my IP direct as initially was told would have to wait until Tuesday for an answer which is totally unacceptable. I agree with you Melanie, that Ishould have been able to speak with the IP direct, I appreciate she is busy, and this is a point that i am slightly concerned about as I look like I am having to take a pay cut at work very shortly

Sorry to hear that your rebate is to be treated as a windfall, I don't agree that you should have to do that. After all, you have paid it out initially.

I would still be inclined to try and speak to your IP directly after all that is what they are there for with due respect.
I do not see how this can be classed as a windfall and hand some of it over especially when you have already paid your tax - seems very unfair and I would fight it
Totally agree, it seems totally unfair when you have paid this money out in the first place.

i do agree, i really do, I have spoken with them again today but they wont budge, they say that due to the change in tax code i would have had more disposable income had the mistake not occured. I have pointed out that i am being penalised twice but they still say additional income. what else can i do??

I don't think there is anything you can do omega. Unfair it may be, but your IP has the last say.

Has that come from your IP or a case worker Omega? If it's not directly from your IP I would keep pushing to be honest, especially as you may have to take a pay cut.

I firstly spoke with the 'assistant' then emailed the IP direct, who then informed her 'assistant' what to say to me. She has emailed me direct though which i suppose is something

That's interesting - I'm due a tax refund next month and Sue told me that it would be classed as a windfall and that I'd have to pay 100% of it over. I suspect it could be because it's likely to be quite a large sum, or because it was tax overpaid before entering the IVA - could you confirm?
