here's one for you:
I have just had a call from blackhorse in regards that they have not accepted my DMP offer of £49.23 per month that myvesta has set up for me, they want a minimum of 89.30 per month and will stop all interest until the debt is paid off ( i don't think so) advised couldn't offer any more as all the surplus i had went to the DMP and was being distributed to all creditors, so she said we are not accepting it, we are now going to put a charging order on your house, i said thats fine but don't you need to have a ccj first, she stumbled a bit and said well yes we will take you to court and the judge will give us priority because the debt is over 21k and will force a bigger monthly payment, i said are you sure, if i haven't got it he can't sqeeze any more out of me, and then also he may say as i am making every effort that you may have to accept a lower payment, she was a bit flumaxed and said thats the chance we will take however he will go more for us than he would you, i said thats fine then, oh by the way i am declaring myself BR in the next couple of months, thats ok she said we will have priority over other creditors when your house gets sold, ok i said but there is very little equity after the OR has taken his cut and you would have gotten more back in an IVA, apart from the fact i will be BR before a ccj or CO will be placed.
are you returning my payment then i asked, err no we will take any money we can off your accout, ( does that not mean they are accepting some form of payment?)
she then asked me to think about making a payment of 89.30 this month to stop it going to the legal dept, and stop the CO, i refused as i can;t afford it, so she said if you carry on paying myvesta and we set up a seperate monthly order to top the payment up to 89.30 and we will accept that, again i said i am sorry but i cannot afford to do that, she got a bit shirty and said you do owe this money, i said i appreciate that, i came to you one year ago when i was struggling and informed you, after the telephone conversation i had a loan for 21k do you not think that being a responsible lender you should have offered that to me?
silence, its not really down to that is it?
please rethink she said and telephone me back in the next few days on this number.

i telephoned myvesta and informed them of the conversation and that they rejected the offer, pardon they said are you sure, we had a very long conversation yesterday with another person who accepted the offer and has stopped all further charges for the next six months.
i tell you if i hadn't been so clued up now because of the forum and had i not been going BR i would have panicked and fell for that one.so its shows you what level the creditors will stoop to, to put the frighteners on you, never agree to anything over the phone is my motto now, ask them to put everything in writing for your consideration.

Well said Kez, she was on a comission perhaps? U was told by my supervisor that if they take you to court and its down in black and white that youre paying all you can afford, the judge may ask for less as its a waste of court time.

well done, kerri! I was told 3 March by a creditor that even though I was going BR I 'had' to make a payment to HSBC. I said I couldn't or the OR wouldn't like that my paying one over the other creditors. I was then informed that there will be a CO. I replied well I knew that because I had a letter arrive stating that would happen.

He then said-get this one and I quote,'' HBSC does NOT reconize bankruptcy.'' I said I beg your pardon? He repeated it. I said,'' really, then this one will be the first in England that they will accept. Gee! I am making bankruptcy history. I'll be a case study for years to come in insolvency pratitioner's classes.Gosh, me helping the IPs of tomorrow.I feel so proud.'' I then promptly disconnected.

As Catherine Tate would say,'' How DARE he?'' lol

I had a similar call from HSBC a while back now, they said you simply must make a payment with a non HSBC card, I said I do not have a card I am going BR. Well in that case you will just have to make a payment before that, it is imperitive. I said I cant, I have no money now. We will take legal action then and you will be in court, I said well why dont you make me bankrupt instead. He said if you can afford to go BR you can afford to pay, any court will know that.

lol Lily! I wonder where they receive their information from regarding bankruptcy? Hmmm, maybe the guy you spoke to thought if you can afford the BR fees, you can afford to pay the bill? No way, Jose (smile).

I think they sit at work reading from a Monty Python script looking for a *sign* lol...a pound sign!

He wanted me to pay my BR fees to HSBC, seemed a far better solution to him anyway. Now why didnt I think of that? I was too busy thinking about what he looked like, a clown in a suit, a mugger in a balaclava, half man half frog, with a tail to whip debtors? An octapus with eight arms and a phone in every one of them, but no brain? (HSBC employ a lot of these). Maybe he thought I only had 1 month to live, well thats if he could think.

I am suprised you didnt know this DD for info its on the idiots guide to getting money out of debtors. Here's a quote. Tell the owers anything, just get the ********* money.

lol lily got to admit what do hsbc employ, now don't you think you would have felt better paying hsbc and not going BR and gee DD what a case history the first BR hsbc are going to accept just cos we owe money do they thing we came up on the last banana boat, at least it gives us a laugh
