thankyou for your replies i didnt get on here either over the weekend, but any how i have heard on the grape vine that baines and ernst/blair endersby is being taken over or passed on to grant thornton when i spoke to my IP on friday he told me nothing about this and im a bit annoyed as i still havent got my proposal and am wondering if it will ever arrive if now they changing over but oh well 2nd payment due in next couple of days then hopefully get creditors meeting after that and finally be able to make my payments to the creditors in may ( happy bitrhday to me lol ) oh also i did accept new bedroom furniture but unfortunatly double wardrobe wont fit up the stairs and now have to take a window out to get it in lmao oh well i maybe skint but at least i will have a lovely bedroom ....will keep you posted thanx again kyla xx[:)][:)]

The person you spoke to on Friday may well not have known about it kyla - I think it only came out then.

There is still time for you to cancel that payment and choose another firm if you want to.

seems a waste of money may just ring them tomorrow and see how much longer its going to take as my creditors arent gonna wait forever and i cant keep fobbing them off if b and e arent doing anything about it im now seriously considering going bank rupt so much easier and it would save me £15000 that only the half or what i would be paying back in an iva the other half would be written off but at least i pay nothing apart from bankruptcy fee no equity in my house and i got children so they dont even want that seems like the easier option....fed up now with the stress!!

If you have more than £20 disposable income you will be subject to an Income Payment Agreement / Order in BR, and all of your surplus will be paid into this for a period of 3 years.

well i have no surplus income so they cant have it may well be looking into this because it just seems a lot less hassle and im just fed up and stressed with it all xx

Kyla, if you are looking at an IVA then you do have disposable income. This would more than likely have to be paid across to an IPA as Skippy says.

i would get rid of disposable income into partners bank account so i personally wouldnt have any

That is totally wrong Kyla and I am sure the Official Receiver will be able to find that out. They have far reaching powers.

The OR will want proof of your income and expenditure so hiding anything isn't an option, and to be blunt is fraudulent. If you do this and the OR finds out, expect everything to be gone through with a fine tooth comb, and the high probability of a Bankruptcy Restriction Order/Undertaking.

You should not be dishonest and the OR will make a thorough check of your finances going back some time. They will know that if you were able to look at an IVA then you can afford to pay an IPA.

Don't loose heart Kyla. It seems such a long time when you are waiting to start an iva but in life-long terms it's nothing. Don't do anything silly out of impatience. x

The OR has quite wide ranging powers, including executing search warrants and even arrest ... not someone to be trifled with!
