Firms warned on false IVA claims

The Office of Fair Trading (OFT) has warned 12 firms to stop making misleading claims to people who have declared themselves insolvent.

The firms have been sending unsolicited letters advising recipients to cancel their individual voluntary arrangements (IVAs) and to go bankrupt instead.

The OFT has threatened to fine or close down the firms if they do not stop their mailings.

It said scrapping an IVA could make someone's financial position worse.

"We expect any advice and/or information given to debtors to be in their best interests and it should include a full explanation of the implications of offers or advice," said Ray Watson of the OFT.

Harsh consequences

The letters were deemed misleading because they falsely suggested that the original IVA may have been mis-sold and that bankruptcy would be a better option.


HOW TO GO BUST


Bankruptcy: The traditional way of escaping overwhelming debt. Ends after one year, but you are likely to lose all your assets including your house to pay something to the creditors
IVA: A deal between you and your creditors, overseen by an insolvency practitioner. Less stigma, less chance of losing your home, but involves paying some of your debts in one go or over a number of years


The companies appear to have obtained the names and addresses of the insolvent people by simply looking at the public register of IVAs held by the Insolvency Service.

The OFT pointed out that if an IVA - an agreement to repay debts over a period of time - were scrapped in favour of bankruptcy this could have severe consequences.

It said the initial money spent on setting up the IVA would have gone to the insolvency practitioner to meet their costs, and so the original debt might not have been reduced.

And bankruptcy itself is a harsher option that could see someone lose their home as well as any remaining control over their finances or their ability to do business.

The regulator said it would not disclose at this stage the identity of the offending firms.

They have been given four weeks to respond and to change any of their advertising and marketing material.

I loved the "How to Go Bust" could you just run that past us with the scenario of no home ownership or shall I do it for you,

How to Go Bust with no assetts

Bankruptcy

Ends after one year may well be 6 months, if no Assetts no loss if on benefits with small income no payments worse case scenario if on high income 50 to 70% payments for three years, Job done.

IVA

Pay over all excess income including benefits totalling 100% over 5 years to an organisation who will control your everyday living expenses and take the fist two years payments as a thank you. Half of all overtime yes we want that.

Bankruptcy or IVA anyone can sell the schemes to suit ourselves the reality is IVA is for some and Bankruptcy is for others, the problem is the IVA factories need the commision fees to pay their salaries and shareholders, its about time IVAs were only placed when it is in the beneficial interest of the client and not of the provider.

Highly suspicious first post. The fact is I've been contacted by these people, not using my full name in the address of a letter which could have been opened by anyone.

And I am keeping this entirely secret from others in my household with the same surname.

BR can last up to 3 years with a IPO. I've paid into my IVA for over 2 years now, so will be WORSE OFF going BR now. Another 6 years poor credit rating from BR date, a failed IVA, and a IPO to pay for 3 years when I have less than that remaining on my IVA.

I for one am glad something is finally being done following my complaint to the OFT. Still awaiting a response from the Information Commissioner about my complaint about the IVA register breaking the Data Protection Act 1998.
We're willing to wipe the slate clean, give you a fresh start. All that we're asking in return is your cooperation.

lol me too!

I can now actually say I can join the club now!! I got my first ivac letter today, it's only taken them a year. I was feeliong so left out!!!
I was extremely annoyed to quite clearly see all my details through the envelope window though. If they really want to give our shredders something to do and send this rubbish, why do they need to put the reference right where it can be seen?? It's a sure fire way of winding people up!!

I can well do with them not winding people up like that. Hopefully the OFT will put a stop to them but I fear they will just start up another operation under a different name.

The only real way to stop them is to restrict the use of the IVA register. The ICO must do something

Yes you would be most worse off going bankrupt now after two years in an IVA why on earth do you always use situations where an IVA is a god send. If all IPs were of the calibre of Melanie Giles there would not be 12 companies out there doing any business, you forget the companies must have a list of very relieved clients who tell their own story, obviously it is quite ethical for the IVA companies to spend hundreds of thousands of pounds on TV and the media just to tell the debtors can get away with paying only 30% of what they owe to creditors and make a bundle out of a miserable situation.

I am very new to this site an independant and am no way anything to do with the IVA council,to whom I also take issue, but alot of the information on this site is from biased people who obviously earn a living from the industry
