The original IVA will have to be brought to a conclusion, so you will need to tell your current IP that you would like this to happen and that you intend to propose another one. Probably best to give the office a call first to provide us with more specific details, as I would not want to suggest anything to prejudice your current position.

What is the creditors meeting on 20 Nov actually for? Are they seeking to get creditors agreement to a failure of the arrangement, or revising yoyur payments downward? Do you have a copy of the report which was issued to creditors, as this should have been sent to you, and I would like to have a look at that in the first instance.

It seems like you have had a raw deal here! The fact that you haven't paid anything into the IVA, coupled with the fact that the company does not seem to be bothered to contact you , suggests to me that you may have been given bad advice about entering into an IVA in the first place .
I would advise that you speak to the Citizens Advice Bureau and Specifically ask for a "Specialist Debt advisor", as resources can be a little slim with CAB, so ensure you ask for the "specialist" at least its impartial and when you get the specialist they are usally very good,( I have trained with some of them) They will advise you impartialy.
Which is important in your circumstances

Taking your case on the facts provided I would suspect there are other routes you could take and there is no point in entering an IVA with another company if you have had previous issues paying into the previous IVA .

It is also is diffcult to get an IVA through second time round unless there is a major change in circumstances.

It is diffcult to advise, without further background information on to why you did not pay into your IVA, but I am sure there are good reasons,
If an IVA is advised I would go with Melanie as she is one of the fairest and realistic IP's I have had the pleasure in sending clients to.

But also I suggest you go to Citizens Advice Bureau as a first port of call to get a good overview of all the solutions available

Hi Doug
Thank you for all that.

We did pay for about 8 months, and we were paying before the IVA was confirmed.

We really appreciate all of the advice on this forum. We dont feel so alone now!!

Hopefully tomorrow we will have the correspondence from Synergi!! We will keep you posted.

I have to admit what i don,t understand is how does it take so long for the IP to realise that something was going wrong with the IVA.

I thought the Supervisor had to report to creditors if payments had not been made!

We dont understand it either. It is so frustrating and as i have said on other posts we have made phone call after phone call and we just cannot get any help from them. I asked several questions over the phone to them and they just cannot answer me and refused to continue with my call and so put the phone down on me.

Thank god we found this site because at least we can communicate with other members and experts who make us feel we are not alone, because at the moment we feel like we are going mad!! As soon as we had trouble making payments they knew about it but did nothing to help us.

Hi Melanie

I have just spoken to Synergi and unfortunately was put through to Gary Collins who put the phone down on me the other day!! I asked to speak to Karen Potts (IP) as usual she is never available. Asked to speak to Complaints (Colin Sefton), not available.

I asked Gary Collins why the letter he promised me by special delivery yesterday had not arrived and he said that the draft was with Karen Potts and could not tell me what was in it or when it would be sent. He made me a promise at the beginning of the week and now he is back tracking and denying he said it. I have given him my email address and asked him to send me any copies of 'whatever' to me. I have given him an hour to get the letters to me via email or I will be on the phone again.

This is their usual behaviour with us, we have come up against this brick wall all the way through our dealings with them, which is why this whole process is so very stressful.

I will keep you posted!!

Hi Deborah.s,

You could try writing to your IP with copies being sent separately to the complaints department and the managing director by recorded delivery, clearly stating the facts and sequence of events factually and to the point but using words like 'We are disappointed' 'We are concerned that this has been allowed to happen' but don't give person opinion just assertive phrases that put your point across clearly.

If they don't contact you after that then you could always make a complaint against them to the Insolvency Practitioners Association (IPA) as their is a section on their website about complaints procedure but if you do decide to complain I would inform synergi stating that since you have no satisfactory response/conclusion from their inhouse complaints team then your their information you are making a formal compaint against them to the IPA.

It might seem a lot of hassle but if we didn't complain when things wrong they will get away with time after time.
