I AM COMING UP TO THE 3RD YEAR IN MY IVA, MY HUSBAND AND I ARE THINKING OF MOVING HOUSE, IF THERE WAS A PROFIT CAN THEY TAKE ALL OF IT, CONSIDERING MY HUSBAND OWNS THE PROPERTY ALSO?, IF WE STAY PUT I HAVE HEARD IN THE 4TH YEAR THEY WILL ASSESS OUR PROPERTY, CAN THEY FORCE US TO SELL IF THERE IS A PROFIT?, OR BECAUSE WE HAVE A MORTGAGE DOES THE MONEY BELONG TO THE BANK. CAN THEY FORCE US TO SELL AT-ALL IF THE MORTGAGE IS IN JOINT NAMES WITH MY HUSBAND?

hi Helen
I am no expert but i dont think they can force you to sell your house in the 4th year, i think you have to make reasonable attempts to remortgage it, and if you cant you will have to pay another year of monthly payments, as to them taking all the profit if you sell i really dont know, i would think that if your hubby is not in an iva and owns half the house then half the profit is his to keep, im sure an expert will advice you (correctly) soon.

good luck
