Just a word of warning about recording phone calls. I'm sure our legal experts will correct me if I'm wrong, but I think you legally HAVE to inform someone BEFORE continuing with the conversation that you are recording them. Otherwise it's a breach of some sort of legal right. That's why when you call company's you get messages saying calls may be recorded. They're covering their backs legally. Also, if you are recording, ensure that you don't say anything that can be used against you at a later date i.e promising a payment, a phone call, etc, etc.

When I entered into our IVA I had to photocopy the court document to deal with some of the creditors!!!!

we thought we were going to have to do that but it looks like their systems have been updated as there have been no phone calls today.

i think if anyone has problems with creditors calling all the time until goodness know what time at night - infact i had a call at about 830 on a sunday morning!!! then to just say that you will contact your IP and tell them to put the calls on hold.

i would recommend applying for an IVA to anyone with financial difficulties.

You can record any converation on your phone without informing the person ringing you if the recording is for personal use.

Of course informing the person they are being recorded is the whole point of getting rid of them.

I got lots of phone calls from Morgan Stanley/Goldfish for a while after my iva was accepted, I would say my iva was approved on 5th November and they would keep checking the insolvency register and my details were not on there yet.
As soon as my details were on the insolvency register they updated the system and never called me again.
If anyone keeps getting phone calls as the creditor to check the register and they will see your name[:(]
Be positive & look after yourself, there are more important things in life than debts....

Morgan Stanley/Goldfish were my worse offenders.

My calls started at 8:00am on the dot and went on all day until the last call at 10:20pm and Sundays were no exception.

Record number of calls from various creditors were 57 in one day I had to recharge my mobile it was that bad.

Record number from one creditor in a single 24 hours was 18 calls.

The most abusive and threatening were Morgan Stanley who took over Goldfish. Goldfish were great prior to this.

Tried the I am recording threat with Morgan stanley to be told by their manager as I always refused to talk to a normal adviser that that was my perogative and Morgan stanley would vote against my IVA application as that was their policy in my circumstances.

After than call I sat shaking had a hypo drank a coffee with 6 sugars in it to get my sugars up (I am Diabetic) cried and thought you .............. when all this is over I will do everything in my power to not let any other person go through all the hell I have had.

Don't ever regret going for an IVA I just wish to God I had seen the tv advert sooner.

ummm, not entirely sure about that. Once the IVA is approved, then a company is no longer able to persue you for the debt, and must go to your practitioner. The IVA protects you under law from this. That's the purpose it serves.

Bit worrying if creditors can still harass you after the IVA has gone through. I understand it takes time for all the phone calls to stop but continuing phone calls would make me feel like ending my IVA as that's one of the main reasons i went into one.

Since my IVA was approved I have not received any calls from Creditors chasing payment etc. (except during the initial "settling down" period of a month or so after the Creditors Meeting). One still sends me occasional statements but the balance always remains the same as it was when my IVA was accepted. Other than that all I receive now are occasional letters from Eversheds when Max Recovery buy another of my debts, letters from companies offering me "solutions" to my finances(!) and - bizarrely - occasional letters inviting me to apply for a credit card or loan(!!!).

Important to remember though that we still owe the full amount of our debt to Creditors until satisfactory completion of the IVA.
47 months completed - 13 months to go.

Please don't worry to much as I did not have to many calls after approval of my iva, it was nothing like before it was accepted.

It just takes a little while for them to update all the systems, but after about a week I have never had a single call since.
I just said to my persistant creditor - Morgan Stanley to check the insolvency register which they did while I was on the phone and as soon as my name was registered they appologised and never called me again.

It really wasn't a big problem for me
