Its a meeting arranged by your IP with your creditors to see if they will accept a variation to your IVA

Thanks, why hasnt my IP asked me about this instead of saying that I must pay more and he will not take into consideration daughters fees

You do not need a variation meeting at the moment, as there is no need to vary the terms of your IVA. Your IP is being unreasonable, and you should stick to your guns explaining that you are happy to increase your payments but not prepared to compromise on your daughter's education.

I have been told that in 2003 I was paid too much tax credit over 3000! Every year since 2004 I have received a phone call (just one) to say I owe it when I explain I was told it would be sorted they say no problem. Then a year later they ring back. Now after all these years I am told I have to pay it back. Can this now go into my IVA?

Yes - but was there any reason why it was excluded when the IVA was put forward in 2005? And are you still receiving tax credits, as it is usual for HMRC to deduct any claim from future benefits rather than to pursue you directly.

Hi Melanie, I was under the impression it was a mistake and every year since they have said it would be sorted out. Now they say I have to pay it. I havent received tax credits for a few years as I was told that I did not re do them for two years and could not back date them even though they sent info to old house. I earn too much now I think to get tax credits now.

Ask your IP to include the debt into the IVA. It is unlikely to affect the dividend prospects as you are already paying a higher contribution than was originally offered.

Could you tell me why my parnters income is needed to calculate my payments but not his expidenture (except his part in normal bills like water rates mortgage etc)

Both his income and his expenditure should be taken into account. Is this not happening in your case?

He has a mortgage on a property he owns. he was renting it out but it needs work and has damp so no one can live in it now. The morgage with insurance is 300. He also pays for a car for my daughter on HP at a cost of 90 per month. he pays her insurance car tax and breakdown. He has nothing to do with my IVA but I was told that his expenditure could not be counted and that he should not have got this car.

The insurance alone is 160 per mth. my daughter is 17 so expensive.

You do seem to be getting some rather strange advice from your IP firm - which I wonder if it is coming from the IP himself or from unqualified or inexperienced staff.

If your partner is not subject to an IVA, he can do what he likes with his money, but must be able to pay a fair share to the household bills in accordance with his earning ability.

This is what I thought. They seem to be penalising my partner. When in fact he is really helping by helping my daughter because my stupid mistakes have got me in this trouble in the first place. If it wasnt for him I would have had to go bc two years ago and as there was no equity in the house we own then the creditors would not have got much from me. If i had been given the option of bc I may or may not have taken it. But would I have been better off now as they are asking for 1000 a month.
