thanks, so now I think I can go only for bankruptcy. By the way can someone tell me how much you are paying monthly for your IVA?

If you can pay off your credit card then all should be ok.If you are unable to pay it off then declare it to your IP,they may allow you a payment holiday to pay it off.
I understand your need to move house and you need to talk with your IP,bankruptcy is an option but will always be an option.Do try to work your way through it with your IP

One of the problems is I don't think any of us realises just what a ball and chain around the ankle an IVA can be, it can be really quite restrictive for the life of the IVA ... however, of course, an IVA is still a brilliant solution to addressing personal debt. An IVA is not, though, an easy solution.

Joanna ... by taking out a loan and by having a credit card you are essentially in breach of your IVA, which technically means it has failed ... but more importantly perhaps it shows that you don't seem, to be managing with the IVA as a solution.

It could, however, be seen to have been a step in the journey to addressing your debt problems ... perhaps you now need to take a step back and look at the overall long term perspective. If you have little in the way of assets then perhaps bankruptcy would be the next step in your journey in terms of giving you fresh start.

I too am amazed that Joanna was given a credit card ... and such practices don't serve to make a contribution to our rehabilitation over using credit.

Joanna if you go for br then you will still have to get rid of the card...I know it's hard, I was terrified when we first cut up our cards but now it's nice to look at our bank balance and it be in credit, even if it is only by £5.

I know all of you are correct, but how can i manage some money when we are still paying a lots of money for bills and renting a flat, belive me we are not even going out, because of money. Now we need a deposit pay to rent new flat, and we do not have. Council is not helping with staff like this...

If things are that bad Joanna, then maybe br would be the best way forward for you. That way you will draw a line under the debt and you can have a fresh start,

When I've signed IVA I have been told you will have a fresh start, now when I am asking advisors any questions they are rude to me and not helpful at all. I a paying 372 gbp and probably they are earning money on me so they should be helpful.

There's a lot compain of the same thing, rude, judgemental ip's/advisors. Which company are you with?

Can you please advise me about one thing, I've been told that any extra incomes should be given direct to my IVa company as I can not keep this kind of many. By extra income I mean money from self assesment tax as my husband is self-employed. Is it true??

You would have to have a look at your IVA wording very closely. If you're still unclear, contact your ip, if possible or post it, word for word on here for one of the experts to give their opinion on,

How can you get income from self-assessment tax? Do you mean that your husband is supposed to be paying over his self-assessment provision on top of the IVA payments? This is often a demand received from HMRC and is quite fair as no tax is payable directly to HMRC duirng the fiscal year in which you enter into the IVA.

I mean he paid too much tax and he should have some money back, but for 2006-2007 his money has been frozen by HMRC till he will made assessment for last tax year.

OK so he is due to receive a tax refund. It is questionable whether that should be a windfall or not, as it might be needed as working capital in your husband's business. I would seek the advice of your own IP on this specific point.
