I'm sorry to be a bother and I realise the post was getting slightly bogged down with panic and worry but I actually thought it was useful well to me....can admin please advise what will happen to this info and if they will try and look further into the topic?? The link disappeared and I have now read a message from admin. This site is totally brilliant but and I say this in the most delicate unoffensive manner at times its full of topics which dont always deal with the problems associated with IVA's. It not realistic to expect to sale through the process without the occasionally problem or hiccup and the forum is here to get all views by members some members will feel its very important to them and to others at different stages of the IVA process will have no relevance to them. Melanie did advised that the topic had been brought up by Storm back last year, but did anyone look further into then? Storm has not been on the site so will this topic disappear or will it be filled on the forum so other members can look at it just in case it may be happening to them. Like I said at the very beggining of this topic I have no wish to offend or be of bother just my thoughts. xxx

The whole subject is going to be investigated and no doubt there will be another post when there is something to report.
A lot of things posted on the thread were worrying for new people and not backed up with any proof, but if you want to read what Storm has said in the past you can find his posts by clicking on the members link and finding his name.
Skippy x I can back up everything I wrote, if you like you can have a look at my credit file. My credit file has defaults issued as late a a year later my IVA was agreed. Why would it worry new people? This site is not selling the services of IVA companies. Fact that my credit file would not been cleaned up, if this had not been brought to my attention. When you agree an IVA the last default that can be legally issued on your CF file is no later than the day your IVA was agreed (Melanie even brought this up). If I had knew this I would have got my credit file much earlier and have kept a much closer eye on it. I understand completely about not wanting to worry new people but anyone entering into an IVA or bankruptcy needs to know all the facts and points of view. I am the biggest supporter of IVA's and am really frightened about coming out of my mine in two years time, I always try to be positive and would only report truths and facts. Its almost like you only want good thing discussed but this is not a good point to an IVA it could, if the the person is not aware upset a new life after an IVA for however long it took you to find out defaults were put on your CF well after your IVA was agreeded. I dont want to upset anyone and so enjoy all of this forum. Karen[:o)]

We always tell people on here that a default cannot be issued after the IVA was approved and that once completed they should get the creditors to remove it. There is no point worrying before then.
What Skippy was referring to was the original post regarding your record being shot for a lot longer, and this is what new posters will be worried about.

That is useful info Jan - thanks - so at the end of my husband's IVA he gets his credit files - any defaults after the date of IVA approval he writes to the creditors and asks/tells them to remove them. Is that right? Assuming they refuse he would then go to the Information Commissioner - is that right? Thanks. J
Sorry Karen, I wasn't referring to you! I feel the whole thread had got out of hand as there was nothing backing up the original post, and therefore new posters could be unduly worried by this.
As I said Admin are looking into this, and until there is some news, positive or otherwise, there isn't really anything more that can be said on the original post.
Hi Jan hope its sunny for you today !! I wasn't the original poster but OK it was quite an alarming thing for them to say however if I had not read the post got my credit file and found out what was on it technically mine would have been very bad for at least another 3 years on from my IVA finishing. It would have much more helpful if an expert could have told me exactly what I have to do to sort out my credit file. Admin have put it as a social post ?? I still think its important. As I said anyone going into an IVA needs to know so they can help themselves. I think the forum has to be careful regarding comments towards various members as it sometimes looks like a social website (which I know its not). It just that with life there are the good and bad as long as your informed you can del with this if your taken unawares its so much worse. I feel that admin have sort of brushed it under the carpet. I say that not to offend but cant think of any other way to express myself! xxx Karen

Sorry kabby and J, I've just come back with the dogs!
Elv - you are correct - once you have completed your IVA you write to any creditors who have defaulted you after the date it started and tell them to remove the default. They are not allowed to do it.
Kabby - it's absolutely beautiful here. I know you weren't the original poster, it's just that the original post could, and did, upset a lot of people and it wasn't backed up by any hard evidence.
Once the professionals have looked into it, they will post back straight away.
We don't get many posts saying that people's records are shot for any longer than the 6 years so until I hear anything concrete to the contrary, I shan't worry.

No point worrying about it now - we all need to concentrate on getting through the next few years safely!
