So,

I'm really upset.


I made full and final settlement of my IVA 18 months ago in 2011.


It's now 2013.


I just got off the phone with someone who claimed to be from Grant Thornton's PPI department demanding that I sign up to have my PPI investigated for my creditors, I said I had already made my full and final settlement and there's no need to investigate as they agreed this was enough money. The lady on the phone INSISTED it was required that I sign up and let them investigate my PPI otherwise GT wont issue my completion certificate.

I said I believed I could opt out of the PPI thing, I am self employed and have never had PPI as it doesn't apply to me, she said it was a pre-requisite and that I had to.

That, as far as I can tell, is a lie. Other people on this forum have opted out.

I've now been waiting 18 months and GT are taking it upon themselves to chase me for more money, despite me already making full and final settlement over a year and a half ago.

I feel like jumping off a bridge.

I have emailed GT several times and got nothing back.

I can't believe they operate this way.

Has anyone else waited this long?

Can I make any kind of formal complaint against them as this seems like an extraordinarily long time to keep someone under their IVA after full and final settlement.

I am so upset.

Any help or advice would be gratefully appreciated.

Yes you can. Contact the Insolvency Practitioners Association to complain about the IP who is your supervisor. The IPA authorise all IPs at GT.

Alternatively contact the insolvency service who can take forward a complaint on your behalf.

Spaceblimp, take a look through the last 100 or so posts and you will find many people in the same possition. Did they give any perspective on how long it would take from now?

The PPI department said I'd have to contact GT directly at the customer services to get more details as they're seperate parts of the organisation. And I have contacted them but can't get any response via email.

Hi Spaceblimp. I am afraid you are stuck in a long queue! A while ago GT were accepting disclaimers, however, after taking legal advice, they now insist on all cases having PPI investigated. Not to do so could leave them open to action by the creditors.

Rumour has it that they are working on a mass variation, as other firms have and are doing, to allow the issue of completion certificates while PPI is pending.

Oh no, that's awful news.

That means even more delay, and it's already been 18 months. I just can't believe it.

My understanding is before making a formal complaint to the ombudsman or any other external body, you must ensure you have exhausted GT's own internal complaints procedure in fall. Without doing this you will simply be referred back to them.

As foggy has said things are hopefully going to change to allow closures to take place, but at present anyone awaiting their completion certificate is faced with going through PPI reclaims even if they believe there was none.

Only your IP can provide you with specific case advice - we can give you generic advice and share the generic knowledge that we know but specifics relating to your own IVA will need to be addressed through the IP at GT.

I fully sympathise with you and hope this is resolved swiftly.

Just to expand on this, complaints are made to the IP's regulatory bodies. The regulatory bodies have a duty to investigate all complaints they receive and there is NO requirement to have made a complaint to the IP themselves. All of the IPs at GT are licensed by the insolvency practitioners association. They have a responsibility for looking at the IPs conduct. They are not responsible for GT as a company.

My advice is to sign the forms and let them do their investigations. You are probably right that no PPI was sold to you, as you are self-employed - however there have been instances of this happening without client's knowledge, and you would be pleasantly suprised if it were discovered that there was a hidden claim out there.

This is probably the quickest way to get closure of your case, as a regulator is unlikely to be harsh on an IP who is following the duty of care they are going to set for us.

I'm in this position too. The difference in my case is I can't even get started!! I had the same type of phone call in December insisting that I sign the PPI forms when I had in fact been waiting for a "Declaration of No Claim" to arrive in the post for over 5 months!

It's now 5 weeks on from the phone call and I haven't even received the PPI forms. I've emailed EIC to give them a gee-up but they won't even reply. No forms means no start to the process! I have 8 months to go until the 6th anniversary of my IVA start date and I want it done asap so I can get to work on clearing my credit files on that day.

BAH!!!
