Hi. My IVA finished in May 2015. All records of it have now gone from my credit report except for Cahoot who keep trying to tell me that it stays on my record from the date I missed payments with them not the date the IVA started. They were part of the IVA.
Are they correct in doing this as all the other lenders have gone from my report.

They are wrong -- the default should be dated the date the relationship between you broke down -- this is officially the date the IVA started. Have a read here and get them to change it:

Surely you missed payments to Cahoot before the IVA started or did you continue paying them after approval? You seem to imply that the date you stopped paying them was after the IVA commenced which seems a bit odd.

thanks for confirming what I thought! yes payments were missed before the IVA was set up, and they never received an y more from me directly once it was set up.

They are definitely wrong ... its from the date your iva started. Keep pushing them to change it and threaten a complaint to the ombudsman if necessary.

If you missed payments and were sent a notice of default before the IVA started then it's from that date.

If you were not sent a notice of default before the IVA them it's the date of the IVA agreement starting.

You would think, would you not, that companies subject to regulation and dealing with bad debts all the time would have some clue as to the correct procedure...

One of my creditors, Sygma, have the default date marked 5 months later that it should be. I've tried and tried and tried to get them to change it. They even agree on the phone with me that it's wrong and promise to change it. It never changes... Someone, somewhere in the process is clueless and thinks it's right.

Later I may take further action myself but for 5 months I don't really know if I can be bothered!
One pay-cheque away from oblivion!

bit of an update:
Having wrote to Egg and Cahoot, both have disappeared from my Experian report (and my score has rocketed), but when checking on other reports such as Noddle, Cahoot is still showing as in default. Their default date is 18 months after my IVA was set up.
Any advice on who to contact to try and put pressure on Cahoot to sort this out??

Write to the data controller at Cahoot enclosing a copy of your completion letter and ask them to remove it.

I would suggest paying the £2 to check each credit record to see what it says about you and take it from there.

Write to them again and tell them that, if the entry is not removed within 28 days you will complain to the ICO.
