Hi everyone, I'm currently in an iva which I am no longer paying as have been issued with a further bill of £38k which wasn't included in the original iva. Land and property services have lodged the debt with the enforcement of judgements office. I have received a very official letter today basically saying I have 10 days to pay, a lot of scary stuff on it basically saying they can take all my possessions and even issue a warrant for my arrest. Not the nicest thing to come to after work. Just wondering if anyone has had any experience with this or know what the next step is. Any advice appreciated

I have no idea but think that speaking directly with your IP first thing on Monday is essential. Do not be fobbed off with a case worker. Talking of an arrest sounds as serious as it gets.

You must comply with the enforcement of judgements office [EJO] or you could be liable to arrest. Therefore if they have set a time for a meeting you must go and bring whatever they have requested. It sounds like you have received a 'custody warrant' which basically tells you not to dispose of any assets until this issue has been resolved but the name alone does cause fear.

The debt is a separate issue. If it is post IVA the likelihood is that Land & Property [L&P] will make you bankrupt if the EJO are unable to recover the money and that is if your IP does not do so first for non compliance of the current IVA.

It does sound like bankruptcy is inevitable and if you decide to petition yourself the EJO will no longer be involved as the debt would form part of the bankruptcy.

Thanks Michael. I don't know whether I should petition for my own bankruptcy and let l and p or my ip do it. Hate the thought of this interim period I've read the ejo can come to your house and I really don't want this as my parents are elderly :(

The EJO will only ever come to your house to carry out an eviction or if you do not comply with their requests. Just go and see them and they will advise L&P of the outcome of the meeting and they will likely then issue a bankruptcy petition.
