So in effect this could mean that IP's will no longer issue any CC's until all PPI assets are realised? Not withstanding that GT's closure time scale is 6 months (on average) for completion from last payment anyway. Something else to enable IP's to drag their heels and blame something else on never ending delays in issuing the CC. Just dandy, not!!
Last Payment made 04/12/14. Completion Certificate 25/7/15. IVA company GT. No Issues
Any PPI investigation should be carried out DURING the IVA imo; there's plenty of time for them to look, it doesn't take 5 or 6 years!
My view is that a CC should be issued based on the information available - has the IVA been satisfied? If 'yes', then issue the CC. PPI investigations shouldn't keep an IVA 'open' and hanging over peoples' heads. Most of us want to get through it, complete and move on having learned a very valuable lesson.
I certainly don't agree that any subsequent claim for PPI years after a CC has been issued should be valid. The CC states that everything is done and dusted - you're released from your obligation.
There's plenty of time for an IP to investigate during the IVA and realise any monies for the IVA whilst it is still active.
I think all mo dies should be returned to the creditors, it's only right they get back what I used, it's as simple as that. I am in my third week post last payment and am waiting for my CC. signed the Deed Of Assignment
and just waiting, then yesterday out of the blue a letter arrived telling me that I have been awarded nearly 7 k after a decision was reversed, EiF have been dealing with my case, so cheque in the post to my IP
Part of what this is saying is that you do not get 2 bites of the cherry - that if they get it wrong they cannot just go back and come up with the preferred answer.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.
Hubert - if you instruct some firms will still want to rake over the coals with their own claims company. There is also the strong possibility that you will be left with a bill for the fees if a creditor offsets or pays the IP directly.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
Well in less than a year Mel (Clifford Watts) has done pretty much all of it apart from waiting on one creditor. I am therefore sure she will have it all complete and tidied up by the end of the IVA's duration. So glad she kept my PPI side of things.
We claimed back some ppi prior to our IVA and also Mels team claimed what we hadn't claimed for during first 2 1/2 years of being with them, then we were told it had all been investigated, claimed and entered into the pot.
Since being with CF, we've had calls and letters from a different ppi company asking to investigate and have repeatedly told them it's been done already. Touch wood, have had no calls or letters since feb.
I agree that any fund from debts within the IVA should be kept and have paid it all over when found.
Hope that's the end of it now !
Started IVA 27th Feb 2012 - Due to complete 27th Jan 2018 !!
Full & Final submitted and accepted 30th March 2015, paid 10th April 2015 - 3 yrs 1 month into IVA
Completion Certificate received- 30th April 2015!!
It took my IP 14 months to issue a CC, they had my authorisation letters for 16 months for PPI's prior to my CC being issued... Low and behold 2 months after the CC I get a letter from a solicitor in Bradford sending a set of new authorisation letters to claim PPI????... Surely after 16 months I would have thought the whole PPI process would have been done and dusted and if there was a problem I would have expected some form of communication to address this...
