Hi everybody.

I get an allowance every week to pay for my parking and meals etc as I drive a hgv.

This allowance is NOT included in my weekly income as it was agreed that it is spent every week! so I have that in writing in the proposal.

I got a tax rebate on this allowance and would like to know if im entitled to keep it?

Its just over £800, are tax rebates yours to keep? or could I keep this as its part of my weekly allowance that is NOT included in my weekly income?

I think this will be captured under the windfall clause but do check with your IP too be sure

Your IP may allow you to retain this as it is basically compensation for what you have already paid out. There are allowances for HGV drivers agreed with HMRC whether or not the driver sleeps in his cab or a B&B. As Andy says ask your IP.

It depends on how this was originally treated within the IVA, and how your disposable income has been calculated. Your own IP is the best one to answer this correctly.
