Who is responsible for removing land registry restriction ? Will this affect mortgage application ?

Your former IP should have removed this when issuing the completion certificate.

Your ability to remortgage will be affected by the IVA, rather than the restriction.

Hi

Yes your IP should notify land registry

As Foggy states an IVA on your record may make obtaining a mortgage offer difficult, the land registry issue will arise further down the buying/remortgaging avenue

If you don't have any luck with them I believe you can apply directly to the land registry yourself and have it removed by presenting them with documented proof as to why it is no longer applicable.

I just did some checking up on this and you can indeed apply yourself and have it removed, it's free (Google Rx3 form).

They may notify the IP and wait for any objection. If none are raised it should be removed.

If you have your completion certificate it should be easy I'd think.

Michael,

You will need credit reports from a 3 companies to check there is not adverse entries registered on any of these. You will then need an independent broker who specialises in dealing with people who have been in an IVA.
