I have been on a iva for 6 months now however before the iva I had an existing personal injury claim in due to having PIP implants- this claim is 3 years old. I informed the iva people I was waiting for the outcome but at the very least I would receive a payout for removal and replacement surgery and was told this would be fine as it is a medical payout. Today however I have been awarded more than I originally expected and want to know where I stand with my iva.

Only your own IP can definitely say which way he will jump. Most decent IP's allow compensation for pain and suffering to be retained (some don't).
My opinions are merely that .. opinions based on experience. Always seek professional advice.

I agree with foggy. Your IP will give you the definitive answer ..i hope though that you are allowed to retain it.
