can I appeal against a decision made by my iva company in in the fifth year? Both my husband and I entered into an iva, but I have the mortgage for our home in my name. The IVA company asked us to get valuations (two) and try to re-mortgage to release equity if this was not possible then we would have to continue to pay for another 12 months. We do not have enough equity to re-mortgage but they say we have gone over the thresh hold by £874.00 so we have to carry on at £500.00 per month is there anything we can do to appeal?

If you have the £5000 de minimis clause and go over this by only £1 you get the extension.

You can ask for the figures they have worked from and the method used and compare this to the way your proposal says it should be done.

Look closely at the valuations. Are they realistic?

I agree with Plasticdaft, do make sure they're realistic ask for a forced sale valuation where possible (it's what I did).
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
