I have been in an IVA since, approximately, September/October 2015. In recent months, this has become a severe struggle, especially with my partner being consistently in and out of work. Due to struggles, we became in arrears with our mortgage and my partner borrowed from her parents to clear the arrears. I recently discovered that this may be a breach. My partner is starting work soon with a pay date promised at the end of September. How can i approach this with the IVA solicitors?

Hi and welcome,

If your partner is not in the IVA then she can borrow money from whom she wants and use it for whatever she wants.

Just phone your IP and explain that you will make regular payments again from September. I don't think it will be a problem.

You need to keep up with the mortgage payments.

You do need to speak with your IP and explain the difficulties. He / she could maybe assist with reduced payments or an agreed break to get you straight again.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
