With Ebay it is perfect for personal trade but with small businesses on the site, Ebay is having a problems in monitoring the legit business from the illegit and I don't think it wants the hassle.It makes its fortune with personal trade. It has recently lost a lawsuit from the Italian fashion houses and is reeling from that.

Imaging if you selling DVDs, even if you have a VAT number and sell legit items you can still flog the illeg ones in the cover of a legit operation and who would know?? That poses enormous problem for Ebay to police the rule breaking by email as opposed to been a premises.Ebay is easy target for lawsuits.

The advice is surely only sell personal items and put the caveat at end as Kalla has indicated - very worrying though.

thought if i went bankrupt now the amount i have to pay ebay if any cannot be added after bankruptcy?
am i wrong in thinking i can go bankrupt now and if i have to pay ebay a substantial amount of money i can add it after or am i wrong?
barristers charge anything from £400+ an hour they are not like normal solicitors plus i live up north so would have to pay there travelling and lodgings expenses to
dont think you can get a free barrister even if i went to the newspapers would it really make a difference?

This potential debt (claim) relates to any period prior to bankruptcy. Hence if you went bankrupt that claim would be a claim on your bankruptcy estate/. After your release from bankruptcy it could not be claimed from you. Need to know details of what assets you currently have.

i have no assets me and hubby are seperating im waiting for a house to become available, my name is not on the mortgage court case is not till march-may 2009, thought once you were bankrupt and debts happen after the fact you can not include them?

At the time of your bankruptcy you include all your debts. So when you go bankrupt the slate is wiped clean. Even if the judgement on the court case takes place after bankruptcy.

viki been to a solicitor they are estimating in the regionof 20K for legal fees because i need a barrister as the court case is in the high court in london
I just have no way of paying this type of money, so looks like i will be doing a heather mills and defending myself :(

Any Judge will give appropriate time to you in Court for you to present your side of the story. You will get a sympathetic and fair hearing. In fact most Judges bend over backwards to be seen to be fair. Don't worry and just tell the truth.

Hi Look Devine

I have been reading your story and it sounds really tough. I have purchased many items from ebay - but never sold anything - and I am confused by their position as they clearly have the ability within their site for one to open up an ebay shop.

It would be interesting to read their t's & c's and see if it expressley forbids selling items obtained - legally - from overseas. If their is a disclaimer then presumably one has to "accept" their conditions but I for one never read these.

I realise that the High Court is a scary place and incase you need more than moral support I would be please to help if you feel you need the help. I understand that you are not able to pay -and I am not a solicitor, but have been to the high court for various reasons about 45 times so am not a strange. Reviva UK has on occasions also been able to help a number of folk on the forum without charge.

Happy to chat if you feel like it.

Give him a call, you don't often get things offered for free these days, it's a really lovely gesture.

You need to do it asap - it's not long till the 12th.
