He's not allowed to post it directly onto the site.

Paul i think that is a wonderful gesture, and hope you will be able to help Ld i have read the posts and can't believe this could happen, its so frightening,i have bought off ebay but not sold.

i just think how lovely it is that someone can help another person off the forum and give them a shoulder to lean on at this horrible time, it just goes to show how invaluable the help is on this forum, i my self have received it so many times here, just goes to show what can happen when we all pull together.

Hello I sell and buy on ebay...if ebay were made aware of your financial position and advised that you would have to bankrupt yourself if this went to court, then surely they would think there is no point wasting there money and time on this exercise? Do they know this? sorry if this does not sound helpful i just dont see there point.

Heh have just checked ebay have you read this :Verified Rights Owner Program: Ebay should have removed the goods just after you listed them?? did they?? How are you expected to know all the laws and company regulations ?? This has put a bee in my bonnet xx This is bully and harrassement go to the papers !!!![}:)]

Paul may not be a solicitor, but he has helped many people who are in an "underdog" situation, and he certainly knows his way around the High Court. I am sure that a chat with him would be beneficial.

ermmm no ebay didnt remove and an undercover buyer bought 3 items off me who worked for loreal, the problem is they were supposed to be for the usa market and not the eu, I didnt know this at the time though or i wouldnt of sold them

kabby ebays solicitors are apparently ruthless, ebay want us to be found guilty so the onus is off them, dont think i can contact the papers till after the court case, please correct me if im wrong
would the papers really be interested in this?

I think that they might well be interested in a "big enterprise versus an innocent consumer" story - especially as e-bay seem to make up their own rules as they go along. But it would be better to have your day in Court, as I agree with David that the Court Service are actually quite sympathetic to individuals who innocently fall foul of the law when they are taken on by big corporates.

Why don't you ring up your local paper and tell them of this David v Goliath story - the publicity could help you with your fight.

On the face of it there is obviously a case against you.

BUT we will need to ask EBAY & the manufacturer to prove that they have followed all their rules to the letter and what have they done to confirm to you personally that you are not allowed to sell items purchased from abroad.

I remember a few years ago that Tesco started to sell "GREY" Levi jeans. Why are they different to you?

Also I would be interested to see what point of sale material Loreal have when you purchased their product stating "IT IS ILLEGAL TO PURCHASE THESE GOODS TO SELL ABROAD". I assume that you pay for goods then get them over the counter . Thus in UK law the contract is made first so variations cannot be implied afterwards.

Also have Ebay written to you, removed your products, warned you etc etc etc . If the market place is their responsibility then they need to prove they are NOT liable by virute of proving that you are.

Lots to play with and certainly the Courts will be quite forgiving because we don't know all the ropes and haven't got a shiny silver wig. However this can work in our favour.

Where did you get the stuff from in the first place LD? Was it an unwanted gift? If so, I would say you have the right to sell that regardless of where it came from.
