Look divine - Paul Johns has given you more ammunition to help put your point accross - use it and I am sure it will work out OK. How many items were you trying to sell by the way?

I purchased them from a seller in the usa, i did buy them to resell, 3 items were purchased by a lancome representative thats how this all started, i returned all products with the loreal trademark on back to loreal and the proceedings were stayed against me,now ebay have started the ball rolling again, ebay did not state I could not sell them and they didnt remove them from sale either

I suppose it would depend as well on how the items were described on Ebay.

If nothing was on the items to say that they could not be sold in the eu, and nothing was put on the site to say this, would Ebay have taken them off?

Depends as well on how the items were described by the original seller.

Is that individual being taken to court as well? They should not have sold them to you in the first place.

no nothing on them stating for sale only in the usa, my argument is you can only list so many high brand cosmetics a week then ebay put a stop on it stating that you cannot list anymore for 7 days, sooooooo why cant they put same sort of thing on to stop them being sold to countries there not allowed to be sold to

Its likely that Ebay will lose to Loreal, as they have lost a previous case when copies of designer handbags were put up by fake merchants onto Ebay. I am not sure if Ebay then countered sued the 'resellers' but case precedents are vital as prosecution will quote precedents to help the judge in ruling. Ebay is just been crywolf sueing LD. What does it aim to achieve....its a legal publicity stunt as LD isn't a business trader.

Ebay's crass monitoring is the problem....My advise is to use publicity to make Ebay look stupid and OTT. It knows it is not going to be paid by LD. So what is the point?? Bonfire of the vanity

i rang paul later than i said i would unfortunately unable to contact him, it is a nightmare just when you think things couldnt get any worse huh

spoke to paul later last night, had a nice conversation said he will osrt it out for me
sent paperwork to him today to read through
im hoping it doesnt hit court but really cannot see that happening
