I have asked but unfortunately no-one could help or advise as I live in Aberdeen, Scotland. I did get a few replies and they were kind, but couldn't help as I was north of border. My partner was made bankrupt for unpaid council tax and it is nearly a year ago. I have been advised that the OR is about to force sale on my home. We are unfortunately on a joint mortgage, which I added him to back in 1999 (worst thing I ever did. He has never contributed to the mortgage, agreement was he would pay council tax, which I thought he was, until last year. He is now not working and basically given up since last April 2008. Do I have a case to defend in court when they proceed. I am struggling to maintain mortgage payments and we also have a 16 year old son together who is staying on at school to do highers. I'm sorry, I can't help you with your query, but I know that Melanie Giles who posts on this site practices in Scotland, and hopefully she'll be along soon to help you.
I have an office in Aberdeen, and at the risk of upsetting the forum administrators by suggesting I am advertising, we would be more than happy to have a chat with you about your situation.
I will probably get away with this, as your post seems to suggest that you need advice about your position regarding the matrimonial home, rather than a debt problem of your own. If you are looking for personal debt advice as well, I am duty bound to suggest that you select a number of different advisors and choose the one you feel is giving the best advice.
I apologise in advance, Admin, if I have crossed the boundary, but this lady does seem relatively deparate for help.
Another firm to seek help from is Invocas who are based in Scotland.

Many thanks to all who responded to my last posting. Here we are at Monday already and back at work, although I sometimes think, what is the point, I'm getting nowhere with anything just now and am now just waiting on either recorded delivery letter or Sheriff Officers with WRIT from court with the date that it will be heard in court.
I did contact a Solicitor in Aberdeen and was told that even although the Council Tax debt was in my partner's name (as that was the agreement when I put him on the mortgage) that he would pay the council tax, why did I believe it??? I have no defence because the debt is due. I just cannot begin to imagine where to start if the Judge passes a date, I cannot see myself showing people round my home when I love it so much and it has been home for nearly 20 years. I just keep hoping for a miracle or a big win on lottery, some weeks it's hard to buy even a lucky dip. Since I visited Solicitor on Thursday, I feel worse and now have problem sleeping, not going to sleep as I am always so tired, but I waken up with images of strangers at bottom of my bed telling me and my son to GET OUT OF OUR HOME.
I think I have finally gone 'off the track', but I really feel totally useless and so much want to fight, but think there is no fight left. Thanks again everyone who replied. [:(][:(]
