Hello everyone - i need some advice please, our Creditors meeting is on 30th December and up until now the calls from the Creditors in all honesty have been minimal (partly because we are usually at work and partly because we only started defaulting on some of the payments late November - this was because the bank we were with didn't carry out the instructions of canceling all the direct debits on time). Anyway, this morning we had a call from MBNA - to say this call left me very unsettled is an understatement. The lady on the other end basically said that they had not received our proposal, that they had never heard of our IP Company and that they would reject our IVA because we had not defaulted before - she then wanted to know how our circumstances had changed, I tried advising her of our case reference number and the company name and address - she then proceeded in telling me that MBNA have their own in-house IP's who could have done an IVA for us and asked us if the company we were with had taken any money off us, I even gave her the address of where our proposal went to in MBNA and she said they didn't have any offices in this location. She finally advised me that the calls would continue - interest would accumulate and that almost certainly MBNA would reject our IVA proposal. She kept suggesting a DMP as well as being the best way forward. I explained to the lady that this was not an option and that the only options available to us were IVA or going Bankrupt.
After the call I telephoned our IP Company and seeked reassurance, the lady there said this was obviously a last ditch attempt at getting some money off us - however, she never asked any money off us.
Is she right in what she is saying - because we haven't defaulted for months and months - they won't give any consideration to our IVA Proposal and reject it outright on the basis she stated. I'm in a bit of a panic now - this lady has really unsettled me and if I wasn't to going to have a good Christmas before I know for certain I'm not going to now with this worry as well.[V]
Totally ignore the call Simbel! This is from a call centre, which has no bearing on your IVA.

Please be assured this "lady" is talking out of her hat ( I'm being polite). Unfortunately for her, she's a small fish in the big pond of MBNA and would have no say whatsoever in the decision making of the company!
She really is only trying to scare you into making a payment. They'll try anything! Try to ignore the calls.
You're IP would not have put a proposal together if they didn't think it would go through, so pleeeeeeeeassse don't worry and don't let it spoil your Christmas.

trust me its all doggy poo-she cant do a damn thing to you. her call will have NO effect on your iva outcome
i dont know whos propsing your iva and whether theyre open today-some shut a little early but all you do is be polite but firm and say they need to contact your firm for further guidance. theyre becoming more aggressive becauseits literally a week til your meeting but this is also a sign of desperation on their part.
if you can click off the phone as much as you can for the next week-use the mobile and enjoy tomorrow-this woman is a sales rep-in a call centre-most likely from an agency-not even from mbna and wants her xmas money

Julie, the thing is that she didn't actually ask for any money! - she was forcing the issue that MBNA also had IP's and that they could do DMP's and IVA's and why had I not contacted them instead and because our account with them has never really defaulted (but we have only managed to pay the minimum for ages) that the IVA would be rejected.
This call really unsettled us because after reading all the posts on the forum we've never heard of this type of approach.
The one thing I didn't believe her in was our IP Company - they are very reputable and certainly not trying to rip us off - she tried to make me believe that this was some sort of scam.
simbel-all mbna could have done was arranged a debt repayment plan for you-that way they get more money quick-theyre impatient that why hun-trust me ignore the calls-theyre talking phooey and your company are dealing with it-again theyre calling cos theyre getting despeate and will say all kinds of junk
IGNORE them enjoy tomrrow and this is coming from miss jelly worryhead-ask the others !!! i was a total flump last year but i got through and you will be posting your good news next week so mbna can take a hike-theyre not gonna ruin your xmas hun xx we wont let them luv fd xxx

Thefsg - my husband and I have interlocking IVA proposals and MBNA have a big percentage (I would say 20 to 25%).
As I said I didn't for one minute believe what she said about our IP Company - they have been great to us - and they are very reputable, but she made me very worried with the comment about the fact that we hadn't defaulted before that the IVA's would be rejected and that this would be the overall stance taken by all the Creditors involved. That's what has left me worried.
I'm going to do what everyone is saying and not answer the phone anymore for today and try and get back to an even keel - after all the Children are still expecting a Christmas!
Ignore the call Simbel - MBNA do not have their own IP's, she is just trying to scare you. Don't let her get to you.
She has no bearing at all on the voting for your IVA and MBNA are usually very supportive.
A lot of people don't default at all before their IVA's so that's nothing unusual.
I hope she's happy now that she's upset your day.

All utter rubbish - please, please don't let this call upset you any more. Call centre staff haven't a clue! We still got calls from creditors' call centres after IVA acceptance (can take a little while for them to stop) with them denying all knowledge of the IVA..even afer they voted yes!
All the very best of luck for the 30th - if you didn't have a good case your IP wouldn't be putting it forward! Just try and remember that. xxx
